(2) The bankruptcy judges shall hear and determine all cases under Title 11and all core proceedings arising under Title 11 or arising in a case under Title 11, and mayenter appropriate orders and judgments, subject to review under 28 U.S.C. § 158; provided,however, that personal injury tort and wrongful death claims shall be tried in the district courtin accordance with 28 U.S.C. § 157(b)(5).(3) The bankruptcy judges may hear a proceeding that is not a coreproceeding but that is related to a case under Title 11. Resolution <strong>of</strong> such matters shall begoverned by 28 U.S.C. § 157(c).(b)Motions to Abstain or for Withdrawal <strong>of</strong> the Reference.(1) Motions to abstain from hearing a particular proceeding pursuant to 28U.S.C. § 1334(c) shall be first presented to and heard by the bankruptcy judge and shall begoverned by Fed. R. Bankr. P. 5011 and 9014.(2) Motions for withdrawal <strong>of</strong> the reference <strong>of</strong> a case or proceeding shall befiled with the bankruptcy clerk within 21 days after service <strong>of</strong> summons in a proceeding orfiling <strong>of</strong> any objection in a case which renders a matter contested.(3) Upon receipt <strong>of</strong> any motion for withdrawal and associated responses, thebankruptcy judge, within a time period reasonable under the circumstances <strong>of</strong> the matter, shallissue a written recommendation on the motion.(c)Appeals. All appeals from final judgments, orders, and decrees <strong>of</strong> bankruptcyjudges and, with appropriate leave, from interlocutory orders and decrees <strong>of</strong> bankruptcy judgesshall be taken in the manner prescribed by 28 U.S.C. § 158 and Part VIII <strong>of</strong> the Federal Rules<strong>of</strong> Bankruptcy Procedure.(d)Matters Referred to the Bankruptcy Judges Prior to Transfer to the <strong>District</strong>Court or Bankruptcy Appellate Panel. The bankruptcy judges shall hear and enterappropriate orders on all motions related to appeals prior to the entry <strong>of</strong> the appeal on thedocket in the district court or bankruptcy appellate panel, and shall hear all motions related toa motion for withdrawal <strong>of</strong> the reference prior to the entry <strong>of</strong> the certificate <strong>of</strong> transmittal <strong>of</strong>such motion for withdrawal on the docket <strong>of</strong> the bankruptcy court.
