(See alsoLCrR12.3 for Motions to Seal.)LCrR5.1(a)Timing of Initial Appearances.Unless otherwise specifically set, initial appearances will be conducted by theduty magistrate judge at 3:00 p.m. each business day. The following procedures areimplemented to facilitate this docket:(1) The government shall present complaints to the duty magistrate judge asearly as possible, but no later than noon of each business day, absent exceptionalcircumstances;(2) The arresting agency shall present a defendant in custody to the U.S.Marshal for processing no later than noon on the day of the defendant’s first court appearance;and(3) A written pretrial services report shall be presented to the duty magistratejudge and made available to defense counsel and the government by 2:30 p.m. on the day ofthe defendant’s first court appearance.(b)In the event an arrest occurs during regular business hours but at such time thatthe government is unable to comply with subsection (a)(1), the government shall promptlypresent the complaint to the duty magistrate judge, who shall schedule any necessary courtappearance.(c)This rule does not change the current procedure whereby the government may,when necessary, contact the duty magistrate judge or other available magistrate judge afterregular business hours, or weekends and holidays.LCrR5.1.1Records of Recorded Preliminary Proceedings.See LCrR12.2.-39-
III.INDICTMENT AND INFORMATION.LCrR7.1 Related CasesWhere an information or indictment is filed, and (1) that information or indictmentarises out of the same transaction or series of transactions involved in a presently pendinginformation or indictment in this District, or (2) that information or indictment involves thesame defendant who has a presently pending information or indictment in this District, or(3) that information or indictment was dismissed and later refiled, or (4) there are other reasonsthat would entail substantial duplication of labor if heard by a different judge, the governmentshall notify the Court Clerk in writing and the matter shall be assigned to the judge having thelow-numbered indictment or information, subject to the approval of the judges who would beaffected by such assignment. The written notice by the government shall be on a formapproved by the Court. Immediately upon receipt of the related case notice, the Court Clerkshall notify the judge or judges assigned to the cases.
