14.02.16 Transfer Student. A transfer student, in the application of NCAA eligibility requirements, isa student who transfers from any collegiate institution after having met any one of the conditions set forth inBylaw 14.5.2.14.02.17 Waiver. A waiver is an action exempting an individual or institution from the application of a specificregulation. A waiver requires formal approval (e.g., an NCAA committee or a conference, as specified in thelegislation) based on evidence of compliance with the specified conditions or criteria under which the waiver isauthorized or extenuating circumstances (see Bylaw 14.02.6). (Revised: 11/1/07 effective 8/1/08)14.1 General Eligibility Requirements.14.1.1 Postseason and Regular-Season Competition. To be eligible for regular-season competition,NCAA championships, and for postseason football bowl games, the student-athlete shall meet all general eligibilityrequirements.14.1.2 Validity of Academic Credentials. As a condition and obligation of membership, it is the responsibilityof a member institution to determine the validity of the information on which the eligibility of a studentathleteis based. Therefore, it is the responsibility of a member institution to determine whether a transcript is validfor purposes of applying appropriate NCAA legislation to the eligibility of a student-athlete when the institutionreceives notification, or otherwise has cause to believe, that a student-athlete’s high school, preparatory school ortwo-year college transcript is not valid.14.1.2.1 Invalidation of Academic Credentials After Initial-Eligibility Certification. If a studentathlete’sacademic credentials (e.g., transcript, test scores) are invalidated after his or her initial eligibility hasbeen certified, the institution must report any violation that may have occurred as a result of the student-athlete’sreceipt of financial aid or participation in practice or competition and declare the student-athlete ineligible forcompetition. If such a violation occurred, the student-athlete remains ineligible for intercollegiate competitionunless eligibility is restored by the Committee on Student-Athlete Reinstatement regardless of whether an initialeligibilitywaiver is granted after the invalidation of the academic credentials. (Adopted: 3/3/11)14.1.2.2 High School Review Committee. The High School Review Committee shall have the authorityto establish policies and procedures related to the academic review of high schools and to determine the validityof a high school (e.g., core courses, curriculum, grades) for the purpose of meeting initial-eligibility requirements.A review may result in a determination that a high school shall not be used for the purpose of meetinginitial-eligibility requirements. The policies and procedures for the review and determination of the validity of ahigh school shall be approved by the Academic Cabinet. (See Bylaw 21.6.4.) (Adopted: 1/8/07, Revised: 11/1/07effective 8/1/08)14.1.2.3 Student Records Review Committee. The Student Records Review Committee shall have theauthority to establish policies and procedures related to the review of a prospective student-athlete’s academiccredentials and to determine the validity of a prospective student-athlete’s academic credentials for the purposeof meeting initial-eligibility requirements. A review may result in a determination that a prospective studentathlete’sacademic credentials shall not be used for the purpose of meeting initial-eligibility requirements. Thepolicies and procedures for the review of academic credentials and the determination of the validity of suchcredentials shall be approved by the Academic Cabinet. (See Bylaw 21.6.5.) (Adopted: 1/8/07, Revised: 11/1/07effective 8/1/08)14.1.2.4 NCAA Eligibility Center. An institution shall use the NCAA Eligibility Center approved by theExecutive Committee to determine the initial eligibility of a student-athlete. (Adopted: 1/19/93 effective 8/1/94,Revised: 1/10/95, 3/10/04, 4/27/06, 1/8/07, 5/9/07)14.1.2.4.1 Institutional Responsibility. An institution is responsible for promptly reporting all discrepanciesin information used in a student-athlete’s initial-eligibility certification to the NCAA EligibilityCenter. Discrepancies in information include, but are not limited to, corrections, additions, potential academicmisconduct with regard to high schools attended, grades, completion of coursework or test scores.(Adopted: 4/27/06, Revised: 5/9/07)14.1.3 Student-Athlete Statement.14.1.3.1 Content and Purpose. Prior to participation in intercollegiate competition each academic year, astudent-athlete shall sign a statement in a form prescribed by the Legislative Council in which the student-athletesubmits information related to eligibility, recruitment, financial aid, amateur status, previous positive-drugtests administered by any other athletics organization and involvement in organized gambling activities relatedto intercollegiate or professional athletics competition under the Association’s governing legislation. Failure tocomplete and sign the statement shall result in the student-athlete’s ineligibility for participation in all intercollegiatecompetition. Violations of this bylaw do not affect a student-athlete’s eligibility if the violation occurreddue to an institutional administrative error or oversight, and the student-athlete subsequently signs the form;however, the violation shall be considered an institutional violation per Constitution 2.8.1.
