An institution or team subject to penalty (or penalties) due to its failure tosatisfy the appropriate standards of the academic performance program may appeal the application of such penalty(or penalties) to the Committee on Academic Performance, as specified by the committee’s policies and procedures.(Adopted: 4/29/04, Revised: 10/27/11; applicable to penalties assessed for the 2012-13 academic year and beyond,7/31/13)14.12.2.1 Authority and Duties of Committee. The Committee on Academic Performance shall act onappeals from institutions or teams subject to penalty (or penalties) pursuant to the legislation and the standardsand procedures of the academic performance program published to the membership on an annual basis. Thecommittee’s determination shall be final, binding and conclusive and shall not be subject to further review byany other authority unless otherwise specified in this bylaw (see Bylaw 14.12.2.2). An institution may not seek an appeal for substitution of thecommittee’s judgment.14.12.3 Establishment and Revision of Academic Performance Policies and Procedures.14.12.3.1 Amendment of Policies and Procedures. The Committee on Academic Performance may establishor amend the policies and procedures of the academic performance program. The policies and proceduresgoverning the administration of the academic performance program are subject to review and approval by theBoard of Directors.
