RULE OF LAWcapacities and functioningof institutions8As far as police is concerned, reviewing of themechanisms of cooperation between the Centraland Regional Anti-Trafficking Units in HumanBeings was done in the second quarter of 2009.Cooperation between central and regionalpolice units has not been all that effectivebecause the responsibilities were decentralized(reporting lines). From February 2010,responsibilities were centralized, thusDepartment for Anti-trafficking became aunified structure.The warning relies on the delay of centralizationbecause it was supposed to happen in thesecond quarter of 2009. In May 2010, a neworganizational structure of the Kosovo Policewas approved. The Sector of Investigations ofTrafficking in Human Beings is advanced andnamed the Directorate of Investigation ofTrafficking in Human Beings. Under this reorganization,in accordance with the actionsforeseen in the EPAP, a decision was taken toincrease human capacities, so that the numberincreases from 35 employees to 57 officers and 3other civic police officers.Also, the necessary number of staff at regional6centres has been assigned. To accomplish thisplan, in September announcements were made7to fill the vacancies created. But, the raise ofnumbers in female gender personnel has not8happened so far.Regional units have 3-4 employees, usuallyhaving a female and others of male gender.Whereas, under the National Strategy forCombating Trafficking in Human Beings andunder EPAP, female police officers weresupposed to be employed because of thecharacter of work. Upon completion of thecompetition, fulfilment of this criterion shall beassessed. At the same time, the centralization ofthese units has enabled taking female policeofficer from another region, in cases whengreater presence of policewomen is required ata certain regional station.9With regard to the judiciary, judges werecontinuously trained in specialized areas suchas money laundering, financial crime andtrafficking in human beings, for the categories ofjudges and prosecutors assigned to solve casesfrom these areas of expertise. Training of judgesand prosecutors is part of the strategy as the trialof trafficking cases are sensitive and skills ofjudges should be at appropriate level sincetreatment of the case and the parties differ.Various international organizations such asICITAP perform training for judges,prosecutors, and police constantly, thusfulfilling this part of the strategy.Cooperation with regional countries is part ofcombating human trafficking. Within thiscooperation, the signing of protocols on crossbordercooperation with Albania, Montenegro,Macedonia and other countries of the regionwas supposed to happen in the fourth quarter of2009. Success has been shown upon signing theagreement for "Readmission of Persons" inNovember 2009 with Albania, "MutualMovement of Citizens" with Albania in March2010, "Cross-Border Police Cooperation" withthe Republic of Albania in January of 2010, andagreement on "Police Cooperation" with theRepublic of Macedonia in January 2010.In addition to achievements, there are alsodelays in fulfilling the obligations arising fromEPAP. In this aspect, there is a lack of agreementswith the Republic of Montenegro. However,with countries where there is lack ofarrangements, MIA and Kosovo Police developtheir cooperation according to StandardOperating Procedure (SOP), with the assistanceof other mechanisms such as IOM and EULEX.6 Plannings are: Central Directorate and Section 17 police officers and 3 civil officers, Prizren unit- 7 police officers,Prishtina 8, Peja 7, Mitrovica 6, Gjilan 6, Ferizaj 6.7 Arben Paçarizi, acting director on the Directorate of Investigation of Trafficking in Persons, an interview held in me 25 October, 2010, Prishtina.8 Interview with the Police in the Regions: Mitrovica, Peja, Ferizaj, Gjilan, Prizren.
