Elements of Offense C.R.S. Citation<br />

54. Vehicular eluding. Any person who attempts <strong>to</strong> elude a peace officer<br />

while operating a mo<strong>to</strong>r vehicle, and which results in bodily injury <strong>to</strong><br />

another person, <strong>commit</strong>s a <strong>class</strong> 4 <strong>felony</strong>.<br />

55. Failure <strong>to</strong> leave premises upon request of a peace offlcer. Any person<br />

who barricades or refuses police entry <strong>to</strong> any premises through use or<br />

threat of force, fails <strong>to</strong> leave upon request by a peace officer outside the<br />

structure, and holds another person hostage with use of a deadly weapon<br />

<strong>commit</strong>s a <strong>class</strong> 4 <strong>felony</strong>.<br />

Offenses Against Public Peace, Order, and Decency<br />

56. Dog-flghting -penalty. Any person <strong>commit</strong>ting a second or subsequent<br />

violation <strong>commit</strong>s a <strong>class</strong> 4 <strong>felony</strong>.<br />

Offenses Relating <strong>to</strong> Firearms and Weapons<br />

57 Possessing a dangemus or illegal weapon. A person who knowingly<br />

possesses a dangerous weapon <strong>commit</strong>s a <strong>class</strong> 4 <strong>felony</strong> for a second<br />

violation and each subsequent violation.<br />

58. Possession of weapons by previous offenders. A second or subsequent<br />

offense of possession of a weapon by a person who has previously been<br />

convicted of or adjudicated for a <strong>felony</strong> and when the weapon is a<br />

dangerous weapon or when the conviction was .for or the adjudication<br />

was based on an offense involving burglary, arson, or any <strong>felony</strong><br />

involving the use of force or the use of a deadly weapon is a <strong>class</strong> 4<br />

<strong>felony</strong>.<br />

59. Unlawfully providing or pennitling a juvenile <strong>to</strong> possess a handgun.<br />

Any person who intentionally, knowingly, or recklessly provides a<br />

handgun <strong>to</strong> any person under the age of 18, or any parent or legal<br />

guarding of a person under 18 who knows of such juvenile's possession<br />

of a handgun and fails <strong>to</strong> make reasonable efforts <strong>to</strong> prevent such<br />

possession, <strong>commit</strong>s unlawful providing or permitting a juvenile <strong>to</strong><br />

possess a handgun, a <strong>class</strong> 4 <strong>felony</strong>.<br />

60. Unlawfully pmviding or pennitling a juvenile <strong>to</strong> possess a handgun.<br />

Any parent or guardian who intentionally, knowingly, or recklessly<br />

provides a handgun <strong>to</strong> a juvenile or who permits a juvenile <strong>to</strong> possess a<br />

handgun, even though the parent or guardian is aware of a substantial<br />

risk, fails <strong>to</strong> make reasonable efforts <strong>to</strong> prevent the commission of the<br />

offense, <strong>commit</strong>s the crime of unlawfully providing or permitting a<br />

juvenile <strong>to</strong> possess a handgun, a <strong>class</strong> 4 <strong>felony</strong>.
