Elements of Offense<br />

40. Misuse of ofcficial in fornation. Any public servant, in contemplation of<br />

official action by himself or in reliance on information <strong>to</strong> which he has<br />

access in his official capacity and which has not been made public,<br />

<strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong> if he: (1) acquires a pecuniary interest in any<br />

property, transaction, or enterprise which may be affected by such<br />

information or official action; or (2) speculates or wagers on the basis of<br />

such information or official action; or (3) aids, advises, or encourages<br />

another <strong>to</strong> do any of the foregoing with intent <strong>to</strong> confer on any person a<br />

special pecuniary benefit.<br />

41. Issuing a fulse cethpcate. A public servant who is authorized <strong>to</strong> make<br />

and issue official certificates or other official written instruments <strong>commit</strong>s<br />

a <strong>class</strong> 6 <strong>felony</strong> if he makes and issues such an instrument containing a<br />

statement which he knows is false.<br />

42. Tampering with physicul evidence. Tampering with physical evidence is<br />

a <strong>class</strong> 6 <strong>felony</strong>.<br />

Offenses Against Public Peace, Order and Decency<br />

43. Harassment by stalking. A person <strong>commit</strong>s harassment by stalking by<br />

making a credible threat <strong>to</strong> another person, and in connection with the<br />

threat, repeatedly follows that person or a member of that persons'<br />

immediate family. A person <strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong> for a frrst offense.<br />

44. Firearms, e.yplosives, or incendiary devices in facilities of public<br />

transportation. A person <strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong> if, without legal<br />

authority, he has any loaded firearm or explosive or incendiary device in<br />

his possession in, or carries, or brings any of such items in<strong>to</strong>, any facility<br />

of public transportation.<br />

45. Unlawful ownership of dangerous dog. Unlawful ownership of a<br />

dangerous dog when the dog inflicts bodily injury upon a person is a <strong>class</strong><br />

6 <strong>felony</strong> for a second or subsequent violation.<br />

46. Wimtapping prohibited. Wiretapping is a <strong>class</strong> 6 <strong>felony</strong>.<br />

47. Eavesdropping prohibited. Eavesdropping is a <strong>class</strong> 6 <strong>felony</strong>.<br />

48. Illegal telecommunications equipment. Any person who makes,<br />

possesses, or uses illegal telecommunications equipment, or who furnishes<br />

or sells such equipment <strong>to</strong> another, <strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong> if it is the<br />

second or subsequent violation within five years of a previous conviction.<br />
