Uniform Controlled Substances Act of 1992<br />
69. Controlled substances. It is unlawful <strong>to</strong> manufacture, dispense, sell,<br />
possess, or distribute a controlled substance, and it is a <strong>class</strong> 4 <strong>felony</strong>:<br />
if the violation is based on the possession of a controlled substance<br />
listed in schedule II; or<br />
if a person is convicted of a first offense for such activity in the case<br />
of schedule III controlled substances; or<br />
if a person is convicted of a second or subsequent offense for such<br />
activity -in the case of schedule IV controlled substances.<br />
70. Offenses relating <strong>to</strong> marijuana. The following offenses involving<br />
marijuana or marijuana concentrate are <strong>class</strong> 4 felonies:<br />
A second or subsequent conviction for possession of eight or more<br />
ounces of marijuana or any amount of marijuana concentrate;<br />
An initial conviction of dispensing (with consideration) over one<br />
ounce of marijuana by a person aged 18 or over <strong>to</strong> a person aged 15<br />
<strong>to</strong> 17 or any amount of marijuana concentrate (with or without<br />
consideration) <strong>to</strong> a person under age 18;<br />
An initial conviction of dispensing any amount of marijuana (with or<br />
without consideration) by a person aged 18 or over <strong>to</strong> a person under<br />
age 15;<br />
An initial conviction of cultivating, growing, producing, processing,<br />
or manufacturing marijuana or its concentrate on land owned or<br />
controlled by the person or allowing such activities on his land;<br />
An initial conviction of manufacturing, dispensing, selling,<br />
possessing, or distributing marijuana or its concentrate.<br />
71. Unlawfil a s. Violation of any of the unlawful acts listed in paragraphs<br />
(0) through (t) of section 18-18-414 (1) pursuant <strong>to</strong> the Uniform<br />
Controlled Substances Act.<br />
72. Fraud and deceit. Violation of the provisions of section 18-1 8-415<br />
regarding obtaining controlled substances by fraud or deceit is' a <strong>class</strong> 4<br />
<strong>felony</strong> if the violation is <strong>commit</strong>ted subsequent <strong>to</strong> a prior conviction for<br />
the same offense.<br />
73. Contmlled substances -inducing consumption by jhudulent means.<br />
It is a <strong>class</strong> 4 <strong>felony</strong> when a person by means of fraud or<br />
misrepresentation, causes another <strong>to</strong> unknowingly consume any<br />
controlled substance.<br />
