Inchoate Offenses<br />
1. Criminal uffempt. Criminal attempt <strong>to</strong> <strong>commit</strong> a <strong>class</strong> 4 <strong>felony</strong> is a <strong>class</strong><br />
5 <strong>felony</strong>.<br />
2. Criminal conspimcy. Conspiracy <strong>to</strong> <strong>commit</strong> a <strong>class</strong> 4 <strong>felony</strong> is a <strong>class</strong> 5<br />
<strong>felony</strong>.<br />
3. Criminal ~olicit~on. Any person who attempts <strong>to</strong> persuade another<br />
person <strong>to</strong> <strong>commit</strong> a <strong>class</strong> 4 <strong>felony</strong> <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>. (See<br />
18-2-101 (4)).<br />
Offenses Against the Person<br />
Criminally negligent homicide. Any person who causes the death of 1 8-3- 105<br />
another person by conduct amounting <strong>to</strong> criminal negligence <strong>commit</strong>s<br />
criminally negligent homicide, a <strong>class</strong> 5 <strong>felony</strong>.<br />
Assault in the first depe. If assault in the first degree is <strong>commit</strong>ted not 18-3-202 (2) (a)<br />
after deliberation, but in the heat of passion caused by a highly provoking<br />
act of the victim, it is a <strong>class</strong> 5 <strong>felony</strong>.<br />
Vehicular assault. Any person who drives a mo<strong>to</strong>r vehicle in a reckless 18-3-205 (1) (c)<br />
manner, and this conduct is the proximate cause of the serious bodily<br />
injury <strong>to</strong> another, <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />
Menacing. Any person who menaces another by use of a deadly weapon 18-3-206<br />
<strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />
VioMon of cus<strong>to</strong>dy. Any person who takes or entices any child under 18-3-304 (1)<br />
the age of 18 from the cus<strong>to</strong>dy of his parents, guardian, or legal<br />
cus<strong>to</strong>dian, <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />
Violation ofcus<strong>to</strong>dy. Any parent who violates an order of court granting 18-3-304 (2)<br />
cus<strong>to</strong>dy of a child <strong>to</strong> any person, agency, or institution, with the intent <strong>to</strong><br />
deprive the lawful cus<strong>to</strong>dian of the cus<strong>to</strong>dy of the child <strong>commit</strong>s a <strong>class</strong><br />
5 <strong>felony</strong>.<br />
Offenses Against Property<br />
10. Third degree burglary. A person who enters or breaks in<strong>to</strong> any vault,<br />
safe, cash register, coin vending machine, product dispenser, money<br />
deposi<strong>to</strong>ry, safety deposit box, coin telephone, coin box, etc., <strong>commit</strong>s<br />
a <strong>class</strong> 5 <strong>felony</strong>.
