Defrauding a secured credi<strong>to</strong>r or deb<strong>to</strong>r. A person who intends <strong>to</strong><br />

defraud a credi<strong>to</strong>r by rendering any security interest worthless or<br />

enforceable by disposing of any collated subject <strong>to</strong> a security interest<br />

<strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong> if the value of the collated is four hundred<br />

dollars or more but less than fifteen thousand dollars.<br />

Defrauding a secured credi<strong>to</strong>r or deb<strong>to</strong>r. A credi<strong>to</strong>r who intends <strong>to</strong><br />

defraud a deb<strong>to</strong>r by encumbering a promissory note or contract signed by<br />

the deb<strong>to</strong>r <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong> if the amount owing on such note or<br />

contract is four hundred dollars or more but less than fifteen thousand<br />

dollars.<br />

Unlawfil activity concerning the selling of land. If any person, with<br />

intent <strong>to</strong> defraud, sells the same land twice, he <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />

Failure <strong>to</strong> pay over assigned accounts. A <strong>class</strong> 5 <strong>felony</strong> is <strong>commit</strong>ted<br />

when an assignor for the collection of a debt account fails <strong>to</strong> pay the<br />

assignee any money collected from the deb<strong>to</strong>r, where the sum of money<br />

involved is one hundred dollars or more.<br />

Concealment or removal of secured property. If a person has given<br />

security interest in personal property and conceals or removes the<br />

encumbered property from Colorado without written consent, he <strong>commit</strong>s<br />

a <strong>class</strong> 5 <strong>felony</strong> where the amount of the proceeds withheld is one<br />

hundred dollars or more.<br />

Failure <strong>to</strong> pay over proceeds. Any person'giving security interest and<br />

retaining possession of the encumbered property and having liberty of sale<br />

or other disposition, and who wrongfully fails <strong>to</strong> pay <strong>to</strong> the secured<br />

credi<strong>to</strong>r the amounts due on account thereof, <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong><br />

where the amount of the proceeds withheld is one hundred dollars or<br />

more.<br />

Unauthorized use of ajhncial device. Any person who uses a financial<br />

transaction device for the purpose of obtaining cash, credit, property, or<br />

services or for making financial payment, with intent <strong>to</strong> defraud, <strong>commit</strong>s<br />

the unauthorized use of a financial device. If such cash, credit, property,<br />

or services obtained or financial payments made exceeds four hundred<br />

dollars or more but less than fifteen thousand dollars, it is a <strong>class</strong> 5<br />

<strong>felony</strong>.<br />

Criminal possession of a jinanciu.2 tmsaction device. Any person who<br />

has in his possession four or more financial transaction devices issued <strong>to</strong><br />

different account holders with the intent <strong>to</strong> defraud or which he knows <strong>to</strong><br />

be lost, s<strong>to</strong>len, or delivered under a mistake <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />
