Elements of Offense C.R.S. Citation<br />

49. Unlawful use of iqfonnation. Any person who, having obtained<br />

information pursuant <strong>to</strong> a court order for wiretapping or eavesdropping,<br />

lcnowingly uses, publishes, or divulges the information <strong>to</strong> any person or in<br />

any manner not authorized by law <strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong>.<br />

Offenses Involving Gambling<br />

50. Possession of gambling devices. Possession of gambling devices by a<br />

repeated gambling offender is a <strong>class</strong> 6 <strong>felony</strong>.<br />

51. Gambling information. Any person who knowingly transmits or receives<br />

gambling information <strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong> if he is a repeating<br />

gambling offender.<br />

52. Gambling premises. A repeat gambling offender who maintains gambling<br />

premises <strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong>.<br />

Offenses Involving Disloyalty<br />

53. Inciting destruction of we or property. Any person who advocates the<br />

unlawful destruction of private or public property by the use of physical<br />

force, or the unlawful injury of any person, or the unlawful taking of<br />

human life, as a policy or course of conduct, under circumstances<br />

constituting a clear and present danger that violent action will result<br />

therefrom, <strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong>.<br />

Miscellaneous Offenses<br />

54. Criminal libel. It is a <strong>class</strong> 6 <strong>felony</strong> <strong>to</strong> publish or disseminate any<br />

statement or object tending <strong>to</strong> blacken the memory of one who is dead, or<br />

<strong>to</strong> impeach the reputation or expose the natural defects of one who is alive,<br />

exposing him <strong>to</strong> public hatred, contempt, or ridicule.<br />

Offenses -Making, Financing, or Collection of Loans<br />

55. Ctiminal usury. Any person who knowingly charges, takes, or receives<br />

any money or other property as a loan finance charge where the charge<br />

exceeds an annual percentage rate of forty-five percent or the equivalent<br />

for a longer or shorter period <strong>commit</strong>s a <strong>class</strong> 6 <strong>felony</strong>.<br />

56. Financing criminal usury.<br />
