75. Violation concerning sale of secondhand progerty. Upon a second or
subsequent conviction within a three-year period, any dealer in
secondhand property who fails to make record of a sale exceeding thirty
dollars, to deliver such record to local law enforcement agencies, or to
retain such record for a one-year period commits a class 5 felony.
Offenses - Making, Financing, or Collection of Loans
76. Financing extodonate extensions of credit. Any person advancing
money or property to another whom he reasonably suspects will use such
money or property for the purpose of making an extortionate extension of
credit commits a class 5 felony.
Uniform Controlled Substances Act of 1992
Unlawful use of a contmlled substance. Any person who uses any
controlled substance, except its lawful administration for bona fide
medical needs, commits a class 5 felony in the case of a schedule I or 11
controlled substance.
Unlawful activity relating to controlled substances. It is unlawful to
manufacture, dispense, sell, possess, or distribute a controlled substance,
and it is a class 5 felony:
if a person is convicted of a fvst offense for such activity in the case
of schedule IV controlled substances; or
if a person is convicted of a second or subsequent offense for such
activity in the case of schedule V controlled substances.
Offenses relating to rna@uana. The following offenses relating to
marijuana or marijuana concentrate are class 5 felonies:
a second or subsequent conviction for possession of more than one
ounce but less than eight ounces of marijuana;
an initial conviction for possession of eight ounces or more of
marijuana or any amount of marijuana concentrate.
F d and deceit. Violation of any of the provisions of section 18-1 8-415
regarding obtaining a controlled substance by fraud, deceit,
misrepresentation, or subterfuge is a class 5 felony.
Imitation contmlled substances. The manufacture, distribution, or
possession with intent to distribute an imitation controlled substance is a
class 5 felony.
