Miscellaneous Offenses<br />

75. Violation concerning sale of secondhand progerty. Upon a second or<br />

subsequent conviction within a three-year period, any dealer in<br />

secondhand property who fails <strong>to</strong> make record of a sale exceeding thirty<br />

dollars, <strong>to</strong> deliver such record <strong>to</strong> local law enforcement agencies, or <strong>to</strong><br />

retain such record for a one-year period <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />

Offenses - Making, Financing, or Collection of Loans<br />

76. Financing ex<strong>to</strong>donate extensions of credit. Any person advancing<br />

money or property <strong>to</strong> another whom he reasonably suspects will use such<br />

money or property for the purpose of making an ex<strong>to</strong>rtionate extension of<br />

credit <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />

Uniform Controlled Substances Act of 1992<br />

Unlawful use of a contmlled substance. Any person who uses any<br />

controlled substance, except its lawful administration for bona fide<br />

medical needs, <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong> in the case of a schedule I or 11<br />

controlled substance.<br />

Unlawful activity relating <strong>to</strong> controlled substances. It is unlawful <strong>to</strong><br />

manufacture, dispense, sell, possess, or distribute a controlled substance,<br />

and it is a <strong>class</strong> 5 <strong>felony</strong>:<br />

if a person is convicted of a fvst offense for such activity in the case<br />

of schedule IV controlled substances; or<br />

if a person is convicted of a second or subsequent offense for such<br />

activity in the case of schedule V controlled substances.<br />

Offenses relating <strong>to</strong> rna@uana. The following offenses relating <strong>to</strong><br />

marijuana or marijuana concentrate are <strong>class</strong> 5 felonies:<br />

a second or subsequent conviction for possession of more than one<br />

ounce but less than eight ounces of marijuana;<br />

an initial conviction for possession of eight ounces or more of<br />

marijuana or any amount of marijuana concentrate.<br />

F d and deceit. Violation of any of the provisions of section 18-1 8-415<br />

regarding obtaining a controlled substance by fraud, deceit,<br />

misrepresentation, or subterfuge is a <strong>class</strong> 5 <strong>felony</strong>.<br />

Imitation contmlled substances. The manufacture, distribution, or<br />

possession with intent <strong>to</strong> distribute an imitation controlled substance is a<br />

<strong>class</strong> 5 <strong>felony</strong>.<br />
