Elements of Offense<br />
Sale of a financial transaction device. Any person who, with intent <strong>to</strong><br />
defraud, sells or has in his possession <strong>to</strong> sell, any financial transaction<br />
device which he knows <strong>to</strong> be lost, s<strong>to</strong>len, forged, altered, counterfeited,<br />
or delivered under a mistake, <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />
Criminal possession of a blank jkzitcial transaction device. Any person<br />
who has in his possession two or more blank financial transaction devices<br />
and who intends <strong>to</strong> use, deliver, circulate, or sell them without the<br />
authorization of the issuer or manufacturer <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />
Sale of a blankfinancial transaction device. Any person who delivers,<br />
circulates, or sells one blank financial transaction device which has not<br />
been embossed or magnetically encoded with the name of the account<br />
holder, personal identification code, expiation date, or other proprietary<br />
institutional information <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />
Unlawful manufacture of a financid transaction device. A person<br />
<strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong> if he <strong>commit</strong>s unlawful manufacture of a<br />
financial transaction device, with intent <strong>to</strong> defraud, by: a) falsely making<br />
or manufacturing such a device; b) falsely altering or adding codes or<br />
information <strong>to</strong> such a device; or c) falsely completing such a device.<br />
Equity skimming. Equity skimming of real property is a <strong>class</strong> 5 <strong>felony</strong>.<br />
Computer Crime<br />
34. Computer crime. Any person who uses a computer or computer system<br />
for <strong>commit</strong>ting theft, or for false or fraudulent purposes, <strong>commit</strong>s<br />
computer crime. If such loss, damage, or thing of value involved in the<br />
computer crime is four hundred dollars or more but less than fifteen<br />
thousand dollars, it is a <strong>class</strong> 5 <strong>felony</strong>.<br />
Offenses Involving the Family Relations<br />
35. Pretended criminal abortion. Any person who intentionally pretends <strong>to</strong><br />
end the real or apparent pregnancy of a woman by means other than<br />
justified medical termination or birth <strong>commit</strong>s a <strong>class</strong> 5 <strong>felony</strong>.<br />
Wrongs Against At-risk Adults and At-risk Juveniles<br />
. Crimes against at-risk adults and at-risk juveniles. Any person whose<br />
conducts amounts <strong>to</strong> criminal negligence when the negligence results in<br />
serious bodily injury <strong>to</strong> an at-risk adult or at-risk juvenile <strong>commit</strong>s a <strong>class</strong><br />
5 <strong>felony</strong>.<br />
