NECESSARY DEFENCEAccording to provision article 24. of the Criminal Code of theRepublic of Bosnia and Herzegovina, article 26. of Criminal codeof the Federation of Bosnia and Herzegovina, article 26. of theCriminal code of the Brčko District of Bosnia and Herzegovinaand article 11. of the Criminal code of the Republic Srpska,necessary defence is defence which is necessary for a perpetratorin order to protect himself or other person from an imminentillegal attack. It is a second base for the exclusion of the criminalact in criminal <strong>law</strong> in Bosnia and Herzegovina 11 .An act committed in necessary defence 12 is excusable because thelegislator himself considers that the perpetrator of such act isauthorised for commission of that act. From this definition, itresults that necessary defence, in the sense of institute of criminal<strong>law</strong>, has to fulfil two conditions-the existence of attack andprotection from such attack.
