Without prejudice to Article (125) of the Sector Law, any dispute between the Licenseeand any Person to whom the Licensee is obliged to make an offer pursuant to paragraph1 (and whether as to the making of an offer, the terms offered, the proposed charges orotherwise) may, upon the application of that Person, be determined by the Authority andthe Licensee shall comply with and be bound by any such determination.Oman Electricity Transmission Company SAOC Licence 1-May-2005 Page - 36 -
Condition 24: Duty to offer terms for use of the Licensee's System1. On application made by the PWP, in the case of Exports and/or Imports, or anyLicensed Supplier in all other cases, the Licensee shall (subject to paragraph 3) offer toenter into an agreement for use of System:(a)(b)(c)(d)to accept into the Licensee's Transmission System at such entry point or pointsand in such quantities as may be specified in the application, electricity to beprovided by or on behalf of the PWP or such Licensed Supplier, as appropriate;and/orto deliver such quantities of electricity (as appropriate) as are referred to in subparagraph(a) above (less any transmission losses) at such exit point or pointson the Licensee's Transmission System and to such Person or Persons as thePWP or such Licensed Supplier, as appropriate, may specify; andspecify the use of System charges to be paid by the PWP or such LicensedSupplier, as appropriate; andcontaining such further terms as are or may be appropriate for the purposes ofthe agreement.2. The Licensee shall offer terms for agreements in accordance with paragraph 1 as soonas practicable and (save where the Authority consents to a longer period) in any eventnot more than 28 days after receipt by the Licensee from the PWP or such LicensedSupplier, as appropriate of an application containing all such information as the Licenseemay reasonably require for the purpose of formulating the terms of the offer.3. The Licensee shall not be obliged by this Condition to offer to enter or to enter into anyagreement if:(a)to do so would be likely to involve the Licensee:(i)(ii)(iii)(iv)in a breach of the Sector Law;in a breach of regulations made pursuant to the Sector Law; orin a breach of the Grid Code or the Distribution Code; orin breach of the Conditions; or(b)the Person making the application does not undertake to be bound insofar asapplicable by the terms of the Grid Code or the Distribution Code from time totime in force; orOman Electricity Transmission Company SAOC Licence 1-May-2005 Page - 37 -
