Restrictions on Charges for Transmission System Services3. If, in respect of any Relevant Year, Actual Regulated Revenue exceeds the MaximumAllowed Revenue by more than 3 per cent the Licensee shall furnish an explanation tothe Authority and in the next Relevant Year t+1 the Licensee shall not effect anyincrease in charges for Transmission System Services, the revenue from which isregulated under this schedule unless it has demonstrated to the reasonable satisfactionof the Authority that the revenue from the increased charges is not likely to exceed theMaximum Allowed Revenue in that next Relevant Year t+1.4. If, in respect of any 2 successive Relevant Years, the sum of the amounts by which theActual Regulated Revenue has exceeded the Maximum Allowed Revenue is morethan 4 per cent of the Maximum Allowed Revenue for the second of these RelevantYears, then in the next following Relevant Year the Licensee shall, if required by theAuthority, adjust its charges for the provision of Transmission System Services so thatthe revenue from the increased charges would not be likely, in the judgement of theAuthority, to exceed the Maximum Allowed Revenue in that next following RelevantYear.5. If, in respect of any 2 successive Relevant Years, the Actual Regulated Revenue isless than 90 per cent of the Maximum Allowed Revenue, the Authority, afterconsultation with the Licensee, may direct that in calculating K t in respect of the nextfollowing Relevant Year, there should be substituted for ARR t -1 in the formula set out inparagraph 1 such figure as the Authority may specify being not less than ARR t -1 and notmore than 0.9 (MAR t -1).Provision of Information to the Authority6. Where any change is intended to be made in charges for Transmission System Servicesthe Licensee shall 1 month prior to the date of publication of such changes, notify theAuthority of the proposed change and if required, provide the Authority with:(a)(b)a written forecast of the Actual Regulated Revenue expected in the RelevantYear t in which such change is to take effect and in respect of the next followingRelevant Year t+1; anda written estimate of the Maximum Allowed Revenue, together with itscomponents, in respect of the Relevant Year t-1 immediately preceding theRelevant Year in which the change is to take effect, and for Relevant Year t andRelevant Year t+1, unless a statement complying with paragraph 8 in respect ofRelevant Year t-1 has been furnished by the Licensee to the Authority before thepublication of the proposed change.Oman Electricity Transmission Company SAOC Licence 1-May-2005 Page - 53 -
