proves ineffective, a per<strong>for</strong>mance bond meeting the conditions noted inthe Per<strong>for</strong>mance Contract, or projected annual operating fund surpluses.1.1.7.3. Per<strong>for</strong>mance Contract.<strong>The</strong> public water system shall enter into a contract with the departmentthat includes the following elements (A less stringent method would be awritten certification instead of a contract):a. <strong>The</strong> new technology shall be deemed ineffective if use of thetechnology results in a maximum contaminant level violation,action level violation, or treatment technique violation listed in 10CSR 60 during any three months during a running 12-month periodover the life of the per<strong>for</strong>mance period;b. <strong>The</strong> new technology shall be deemed ineffective if use of thetechnology results in water outages or pressure reduction below 20pounds per square inch gage (20 psig) during any three monthsduring a running 12-month period over the life of the per<strong>for</strong>manceperiod;c. <strong>The</strong> public water system shall maintain financial resources toreplace the new technology with standard technology during the lifeof the contract. <strong>The</strong> reserve funds needed shall be initially based onthe standard technology cost estimate from the engineering reportand shall be increased annually <strong>for</strong> inflation using the federalconsumer price index (or other suitable index);d. <strong>The</strong> public water system will provide the operation andmaintenance, including operator and maintenance personneltraining, as outlined in the engineering report;e. <strong>The</strong> public water system will collect and record all operation,maintenance, and cost records and per<strong>for</strong>m all analysis outlined inthe engineering report;f. <strong>The</strong> public water system shall obtain the services of a professionalengineer registered in Missouri to oversee data collection, recordkeeping, and provide a complete engineering analysis of the newtechnology after one year of operation, after the per<strong>for</strong>mance periodis completed, and (if needed) following the department issuing apreliminary intent to declare the technology ineffective <strong>for</strong> thispublic water system. <strong>The</strong> professional engineer shall submit twocopies of the engineering analysis to the department within sixmonths of the end of the first year, within six months of the end ofthe per<strong>for</strong>mance period, and within six months of the departmentissuing a preliminary intent to declare the technology ineffective <strong>for</strong>this public water system. This engineering analysis shall evaluatethe effectiveness of the new technology <strong>for</strong> its intended purpose andlist all data and calculations supporting this evaluation, note anyproblems with operation or maintenance and including how, when,or if these problems were solved, note actual times spent operatingand maintaining the new technology and compare these with thoseestimated in the engineering report, calculate costs of operating andAug. 29, 2003Page 7
