perishable canned products the statement shall be shown in uppercase letters one-fourth inch in height for containers having anet weight of 3 pounds or less, and for containers having a netweight over 3 pounds, the statement shall be in upper caseletters at least one-half inch in height.35:37-<strong>11</strong>-<strong>11</strong>5. Preparation of marking devices bearing inspectionlegend without advanced approval prohibitedExcept for the purpose of submitting a sample or samples ofthe same to the Director for approval, no person shall procure,make or prepare, or cause to be procured, made, or prepared,labels, brands, or other marking devices bearing the inspectionlegend or any abbreviations, copy or representation thereof, foruse on any product without the written authority of the Director.However, when any sample label, brand, or other marking device isapproved by the Director, new supplies of the labels and newbrands and other marking devices of a character exactly similarto the approved samples may be procured, made, or prepared, foruse in accordance with the rules in this <strong>Subchapter</strong>, withoutfurther approval by the Director.35:37-<strong>11</strong>-<strong>11</strong>6. Labels to be approved by director(a) Except as provided in Subsection (d) of this Section nolabel shall be used on any product until it has been approved inits final form by the Director. For the convenience of theestablishment, sketches or proofs of new labels may be submittedin triplicate through the inspector in charge to the Director forapproval and the preparation of finished labels deferred untilthe approval is obtained. All finished labels shall be submittedin triplicate through the inspector in charge to the Director forapproval. Postage fees for submittal of labels or sketches shallbe at the establishment's expense.(b) In case of lithographed labels, paper takeoffs in lieu ofSection of the metal containers shall be submitted for approval.The paper takeoffs shall be in the form of a negative but shallbe a complete reproduction of the label as it will appear on thepackage, including any color scheme involved. In case of fibercontainers, printed layers, such as the kraft paper sheets, shallbe submitted for approval in lieu of the complete container.(c) Inserts, tags, liners, pasters, and like devices containingprinted or graphic matter and for use on, or to be placed within,containers and coverings of product shall be submitted forapproval in the same manner as provided for labels in Subsection(a) of this Section, except that the inspector in charge maypermit use of the devices that contain no reference to productand bear no misleading feature.(d) Stencils, labels, box dies, and brands may be used onshipping containers and on immediate containers as tierces,barrels, drums, boxes, crates, and large-size fiberboardcontainers provided the markings are applicable to the product,
