part of which is used as living quarters, unless the part forwhich inspection is requested is separated from quarters byfloors, walls, and ceilings of solid concrete, brick, or similarmaterial, and the floors, walls, and ceilings are withoutopenings that directly or indirectly communicate with any part ofthe building used as living quarters.35:37-<strong>11</strong>-12. Sanitation and adequate facilitiesInspection shall not be inaugurated if an establishment is inan insanitary condition or fails to provide adequate facilitiesfor conducting the inspection.35:37-<strong>11</strong>-13. Inauguration of inspectionWhen inspection is granted, the Director shall, at or prior tothe inauguration of inspection, inform the operator of theestablishment of the requirements of the rules. If theestablishment, at the time inspection is inaugurated, containsany product that has not been inspected, passed, and marked incompliance with this <strong>Subchapter</strong>, the identity of the same shallbe maintained, and it shall not be distributed in commerce, orprocessed for such purposes. The operator shall adopt and enforceall necessary measures for complying with all directions as theBoard may prescribe for carrying out the requirements of 2 O.S.Sections 6-290.3 through 6-290.13 and the rules of this<strong>Subchapter</strong>.35:37-<strong>11</strong>-14. Withdrawal of inspection; statement of policy(a) The Board may withdraw inspection from an officialestablishment where the sanitary conditions are such that itsproducts are adulterated, or for failure of the operator todestroy condemned products as required by 2 O.S. Section 6-290.10. and the rules of this <strong>Subchapter</strong>. Inspection will besuspended in accordance with 2 O.S. Section 6-290.10 and theapplicable rules of practice.(b) Inspection service may be withheld by the Director when theoperator of any official establishment or any officer, employee,or agent of the operator acting within the scope of office,employment, or agency forcibly assaults, resists, opposes,impedes, intimidates, or interferes with any inspection employeewhile engaged in or on account of the performance of theirofficial duties. This withholding of inspection will continue ineffect until assurances acceptable to the Board are received thatthere cannot be any recurrences.35:37-<strong>11</strong>-15. Reports of violationsInspection employees shall report, in a manner prescribed bythe Board, all violations of 2 O.S. Sections 6-290.5 through 6-290.13 or the rules of this <strong>Subchapter</strong> of which they have
