pay the cost of the proposed construction will be maintained, and audit of such records and accounts will be permitted at any reasonable time during the project, at the completion of the project, or both. (f) Architectural or engineering supervision and inspection will be provided at the construction site to ensure that the work was completed in compliance with provisions of Section 81130 of the Education Code and that it conforms with the approved plans and specifications. (g) Pursuant to the provisions of Section 8 of the Budget Act, no contract will be awarded prior to the allocation of funds to the Board of Governors by the Public Works Board. WHEREAS, it is understood by Chaffey Community College District that: (a) No claim against any funds awarded on this application shall be approved which is for work or materials not a part of the project presented in this application and as approved by the Public Works Board. (b) The failure to abide by each of the assurances made herein entitles the Board of Governors of the California Community Colleges to withhold all or some portion of any funds awarded on this application. (c) Any fraudulent statement which materially affects any substantial portion of the project presented in this application, as it may be finally approved, entitles the Board of Governors of the California Community Colleges to terminate this application or payment of any funds awarded on the project presented in this application. WHEREAS, the Chaffey Community College District agrees that: (a) The appropriation, which may be made for the project presented in this application, does not make an absolute grant of that amount to the applicant. (b) The appropriation is made only to fund the project presented in the application, as it is finally approved, regardless of whether the actual cost is less than or equals the appropriation. (c) A reduction in the scope of the project or assignable areas shall result in a proportionate reduction in the funds available from the appropriation. NOW, THEREFORE, BE IT RESOLVED BY CHAFFEY COMMUNITY COLLEGE DISTRICT, AS FOLLOWS: Section 1. The Governing Board finds and determines that all of the recitals set forth above are true and correct. Section 2. The Governing Board authorizes the president of the Governing Board and the superintendent/president of the college to sign the formal documents that authorize action on behalf of the District. Section 3. That this Resolution shall become effective upon its adoption. AGENDA ITEM Chaffey Community College District GOVERNING BOARD TOPIC FIVE-YEAR (CAPITAL) CONSTRUCTION PLAN Communication No. IV.F.3.j SUPPORTS BOARD ENDS STATEMENT/ POLICY June 26, 2008 Board MeetingDate This item supports Board Policy 8.3.1, College Facilities – The district will improve the physical learning environment by upgrading and renovating current facilities and adding additional facilities as appropriate, within the limits of district resources. PROPOSAL To approve the 2010–2014 Five-Year (Capital) Construction Plan. BACKGROUND District staff has been working with the Cambridge West Partnership group to develop the 2010–2014 Five-Year Construction Plan, a plan required annually by the state. The Five-Year Construction Plan is the district’s qualifying document for receiving state funding. A total of eight capital construction projects have been identified that represent the district’s intentions for new or remodeled construction over the period of 2010–2014. These projects reflect the current building/facilities programs of the three campus locations—Rancho Cucamonga, Fontana, and Chino. Approval by the board is being requested so that all related documents can be formally submitted to meet the state’s July 1, 2008, deadline. BUDGET IMPLICATIONS N/A RECOMMENDATION It is recommended the Governing Board: a. Approve the 2010–2014 Five-Year (Capital) Construction Plan. b.
