Anexo 3.3 Notas generales Lista arancelaria de Estados Unidos 1. Relación con el Sistema Armonizado de Aranceles de Estados Unidos (HTSUS). En general, las disposiciones incluidas en esta lista están expresadas de acuerdo con los términos del Sistema Armonizado de Aranceles de Estados Unidos, y su interpretación, incluyendo las que se refieren a los productos comprendidos en las subpartidas arancelarias de esta lista, se regirá por las Notas Generales, las Notas a las Secciones y las Notas a los Capítulos del HTSUS. En la medida que las disposiciones de esta Lista sean idénticas a las disposiciones correspondientes del HTSUS, las primeras se interpretarán en el mismo sentido que estas últimas. 2. Tasa base de Aranceles Aduaneros: Las tasas bases arancelarias establecidas en esta Lista reflejan las tasas arancelarias más bajas contempladas en la Columna 1 General del HTSUS vigentes al 1 de enero de 2002, o bien la tasa arancelaria prevista para el 1 de enero de 2004 en conformidad con los compromisos de desgravación asumidos en el marco de la OMC. 3. Desgravación progresiva. Además de las categorías enumeradas en el Anexo 3.3, párrafo 1, esta Lista contiene las categorías de desgravación J, K, L, M y N. (a) (b) (c) (d) Los aranceles aplicables a las mercancías respecto de las fracciones arancelarias incluidas en la categoría de desgravación J se mantendrán en su tasa base durante los años uno a siete año. A contar del 1 de enero del año ocho, los aranceles se eliminarán en cinco etapas anuales iguales y dichas mercancías quedarán libres de derechos a contar del 1 de enero del año 12. Los aranceles aplicables a las mercancías respecto de las fracciones arancelarias incluidas en la categoría de desgravación K se eliminarán en dos etapas anuales iguales a partir de la entrada en vigor de este Tratado y dichas mercancías quedarán libres de derechos a contar del 1 de enero del año dos. Los aranceles aplicables a las mercancías respecto de las fracciones arancelarias incluidas en la categoría L se eliminarán en diez etapas. A partir de la entrada en vigor de este Tratado, los aranceles se reducirán en un 5% anual hasta el 1 de enero del año seis. El 1 de enero del año siete, el arancel se reducirá en un 10% adicional anual hasta el año nueve, y dichas mercancías quedarán libres de derechos a contar del 1 de enero del año diez. Los aranceles aplicables a las mercancías respecto de las fracciones arancelarias incluidas en la categoría de desgravación M se regirán por las siguientes disposiciones durante el período de desgravación hasta el 1 de enero del año 10 del Tratado y a contar de entonces dichas mercancías quedarán libres de derechos.
