Si no hubiere unrepresentante autorizado de los empleados, 0 si el Oficial deSeguridad y Salud no puede deremtinar con razonable certezaquien es tal representante, consultaci con un nfunerorazonable de empleados en relacion con los asuntos deseguridad y salud en el sitio de empleo.(c) El (0 los) representante(s) autorizado(s) por losempleados debenl ser un empleado(s) del patrono. Sinembargo, si a juicio del Oficial de Seguridad y Salud, sedemostrara causa suficiente de por que 1a compadia de unatercera persona que no sea emp1eado del patrono [tal como unhigienista industrial 0 un ingeniero de seguridad] es razonablementenecesaria para llevar a cabo una inspeccion fisicaefectiva y completa del sitio de empleo, esa tercera personapodni acompanar al Oficial de Seguridad y Salud durante lainspeccion.(d) Los Oficiales de Seguridad y Salud est3n autorizados anegarle el derecho de acompaiiamiento bajo esta seccion acualquier persona cuya conducta interfiera con una inspeccionjusta y ordenada. El derecho de acompaiiamiento enareas que contengan secretos industriales estaci sujeto a lasdisposiciones de la Seccion 1903.9(d). En relacion con lainformacion clasificada por una agencia del Gobierno de losEstados Unidos en el interes de 1a seguridad nacional 0 porel Gobierno del Estado Ubre Asociad.o de Puerto Rico en eli.nteres de 1a seguridad local, sOlo personal autorizado a teneracceso a tal informacion podra acompaiiar al Oficial deSeguridad y Salud en aquellas areas conteniendo talinformacion. {3 jun 1983}1903.9 SECRETOS INDUSTRIALES(a) La Secci6n 24(a) de la Ley dispone: "Toda informacionreportada a, 0 en otta forma obtenida por el Secretario 0 surepresentante en re1acion con cualquier inspeccion 0 procedimientobajo esta ley que contenga 0 que pueda revelar unsecreto sobre procesos industriales, sera considerada confidencial,excepto que dicha informacion podr.i sec revelada aotros oficiales 0 empleados concemidos con 1a ejecucion deesta ley, 0 cuando sea relevante en cualquier procedimientobajo esta ley. En cualquiera de dichos procedimientos elSecretario 0 el Tribunal emitini aquellas ordenes que puedanser apropiadas para proteger la confidencialidad de lossecretos sobre procesos industriales."(b) La Seccion 24(b) de la Ley dispone: "Cualquier personaque siendo un funcionario 0 empleado del Gobierno delEstado Libre Asociado de Puerto Rico, 0 de alguno de susauthority to resolve all disputes as to who is therepresentative authorized by the employer and employeesfor the purpose ofthis section. Ifthere is no authorizedrepresentative ofemployees, or ifthe Compliance SafttyandHealth Officer is unable to determine with reasonablecertainty who is such representative, he shall consult witha reasonable number ofemployees concerning matters ofsaftty and health in the workplace.(c) The representative(s) authorized by employees shall bean emp/oyee(s) of the employer. However, if in thejudgment of the Compliance Saftty and Health Officer,goodcause has been shown why accompaniment by a thirdparty who is not an employee ofthe employer (such as anindustrial hygienist or a saftty engineer) is reasonablynecessary to the conduct of an effoctive and thoroughphysical inspection ofthe workplace, such third party mayaccompany the Compliance Saftty and Health Officerduring the inspection.(Ii) Compliance Saftty and Health Officers are authorizedto deny the right ofaccompaniment under this section toany person whose conduct interftres with a fair andorderly inspection. The right ofaccompaniment in areascontaining trade secrets shall be subject to the provisionsof Section 1903.9(d). With regard to informationclassifiedbyan agency ofthe United States Government inthe interest ofnational security or the Commonwealth ofPuerto Rico in the interest oflocal security, only personsauthorized to have access to such information mayaccompany a Compliance Saftly and Health Officer inareas containing such information. (Jun 3, 19B3)1903.9 TRADE SECRETS(a) Section 24(a) ofthe Act provides: "All informationreported to or otherwise obtained by the Secretary or hisrepresentative in connection with any inspection orproceeding under this Act which contains or which mightreveal a trade secret shall be considered confidential,except that such information may be disclosed to otherofficers or employees concerned with carrying out this Actor when relevant in any proceeding under this Act. In anyofsuch proceedings the Secretary, or the court shall issuesuch orders as may be appropriate to protect theconfidentiality oftrade secrets".(b) Section 24(b) of Act No. 16 of August S, 1975,provides: "Whoever, being an officer or employee oftheCommonwealth Govemment ofPuerto Rico, or any ofits
