Los Oficiales de Seguridady Salud no estan autorizados a conceder tal relevo.1903.6 NOTIFICACION POR ADELANTADODE INSPECCIONES(a) No podnin darse notificaciones por adelantado deinspecciones, excepto en las siguientes situaci.ones: (1) Encasas de pe1igro inminente aparente. para permitir al patronocorregir el riesgo 10 mas pronto posible; (2) en circunstanciasdonde la inspeccion pueda ser llevada a cabo mas efectivamentedespues de las horas regulares de trabajo, 0 cuandosean necesarios preparativos especiales para una inspeccion;(3) amndo sea necesario para asegurar la presencia de representantesdel patrono y de los empleados 0 del personalapropiado necesario para ayudar en la inspeccion y (4) enotras circunstancias cuando el Director de Area determinaque notificar por adelantado aum.entaria la probabilidad deuna inspeccion mas efectiva ycompleta.(b) En las situaciones descritas en el p3rraf'0 (a) de estasecci6n, sOlo se podnin dar notificaciones por adelantado delas inspecciones si 10 autoriza el Director de Area. exceptoque en casas de peligro inminente aparente la notificacionpor adelantado podni darla el Oficial de Seguridad y Saludsin tal autOrizacion si el Director de Area no esta disponibleinmediatamente. Cuando se notifica por adelantado. seraresponsabilidad del patrono notificar prontamente al representanteautorizado de los empleados sobre la inspeccion. siel patrono conoce la identidad de tal representante everSecci6n 1903.8(b) en relacion con situaci.ones donde no hayun representante autorizado de los empleados]. The Area Directorshall immediately consult with the Director ofthe Bureau.ofInspections and the Director for Legal Affairs. who shallpromptly take appropriate action. including compulsoryprocess, ifnecessary.1903.5 ENTRYNOT A WAIVERAny permission to enter, inspect, review records, orquestion any person, shall not imply or be conditionedupon a waiver ofany cause ofaction, citation, or penaltyunder the Act Compliance Safety and Health Officers arenot authorized to grant any such waiver.1903.6 ADVANCE NOTICE OF INSPECTIONS(a) Advance notice ofinspections may not be given, exceptin the following situations: (1) In cases of apparentimminent danger, to enable the employer to abate thedanger as quickly as possible; (2) in circumstances wherethe inspection can most effectively be conducted afterregular business hours or where special preparations arenecessary for an inspection; (3) where necessary to assurethe presence of representatives of the employer andemployees or the appropriate personnel needed to aid inthe inspection; and (4) in other circumstances where theArea Director determines that the giving ofadvance noticewould enhance the probability ofan effective and thoroughinspection.(b) In the situations described in paragraph (a) ofthissection, advance notice ofinspections may be given only ifauthorized by the Area Director except that in cases ofapparent imminent danger advance notice may be given bythe Compliance Safety and Health Officer without suchauthorization if the Area Director is not immediatelyavailable. When advance notice is given, it shall be theemployer's responsibility promptly to notify the authOrizedrepresentative ofemployees ofthe inspection, ifthe identityof such representative is known to the employer.
