Ifanemployer has obtained copies ofthese materials, he shallmake them available upon request to any employee or hisauthorized representative for review in the establishmentwhere the employee is employed on the same day therequest is made or at the earliest time mutually convenientto the employee ofhis authorized representative and theemployer.(d) Any employer failing to comply with the provisions ofthis section shall be subject to citation and penalty inaccordance with the provisions ofSection 25 ofthe Act.1903.3 AUTHORITY FOR INSPECTION(a) Compliance Safety and Health OjJicers of theDepartment ofLabor andHuman Resources are authorizedto enter without delay and at any time any factory, plant,place of employment, construction site, or other area,workplace or environment where work is performed by anemployee ofan employer; to inspect and investigate duringregular working hours and at any other time. and withinreasonable limits and in a reasonable manner, any suchplace of employment, and all pertinent conditions,structures, machines, apparatus, devices, equipment andmaterials therein; to question privately any employer.owner, operator, agent, or employee; and to review recordsrequired by the Act and the regulations approvedthereunder, and other records which are directly related tothe purpose ofthe inspection.(b) Prior to inspecting areas containing information whichis classified by an agency ofthe Commonwealth ofPuertoRico in the interest oflocal security or by the United StatesGovernment in the interest of national security,Compliance Safety and Health Officers shall have obtainedthe appropriate security clearance from the applicableGovernment. {Jun. 3, 1983}1903.4 OBJECTION TO INSPECTIONUpon a refusal to permit a Compliance Safety andHealth Officer, in the exercise ofhis ojJicial duties, to enterwithout delay and at any time any place ofemployment orany place therein, to inspect, to review records, or toquestion any employer, owner, operator, agent or employee,in accordance with Section 1903.3 or to permit arepresentative ofemployees to accompany the ComplianceSafety andHealth OjJicer during the physical inspection ofany workplace in accordance with Section 1903.8, theCompliance Safety and Health OjJicer shall terminate the
