During this period, the employee keeps<br />

enjoying the social security that he/she is<br />

entitled.<br />

Article 7: Right of an employer over the<br />

trained employee<br />

Any employee who accomplishes his/her<br />

professional training or up grading shall have<br />

an obligation to continue working for the<br />

institution that sponsored that training for a<br />

period determined in collective conventions,<br />

mutual agreement in enterprise or the contract<br />

between the employer and employee except<br />

where such a change is in the public interest.<br />

However, an employee who wishes to change<br />

his/her employment before the expiry of the<br />

period mentioned above, shall reimburse the<br />

money paid for his/her training or upgrading<br />

within a period determined by the collective<br />

conventions or mutual agreement in the<br />

institution.<br />

This shall also apply to the employee who<br />

terminates his/her contract before the end of<br />

the professional training or upgrading.<br />

Dans ce cas, le travailleur garde son droit à la<br />

sécurité sociale.<br />

Article 7: Droit de l’employeur envers<br />

le travailleur formé<br />

Tout travailleur qui termine la formation ou le<br />

perfectionnement professionnel est tenu de<br />

poursuivre son travail dans l‟entreprise qui a<br />

financé la formation ou le perfectionnement<br />

pour une durée fixée par des conventions<br />

collectives ou des accords d‟entreprise ou le<br />

contrat entre le travailleur et l‟employeur sauf<br />

dans les cas où il est appelé au service<br />

d‟intérêt général du pays.<br />

Cependant, tout travailleur qui change<br />

d‟emploi pour des raisons personnelles avant<br />

l‟expiration du délai indiqué à l‟alinéa<br />

précédant doit rembourser les frais dépensés<br />

pour sa formation ou son perfectionnement<br />

professionnels dans un délai déterminé par des<br />

conventions collectives ou des accords dans<br />

l‟entreprise.<br />

Il en de même pour le travailleur qui met fin au<br />

contrat de travail au cours de la formation.
