Biden President of the USA Pennsylvania, Ave NW White House Washington, DC 20500 Mr. President, My name is Serge M. Fontaine, I am a native of Haiti, now a US citizen residing in St. Louis, Missouri. With deep concern, I watched my country’s environment, socio-economic arena and political spectrum fall into total disarray. As a result of lack of leadership by one individual in the person of former president, Jovenel Moise, whose term of office, according to the Haitian Constitution, expired on February 7, 2021. Through a series of unlawful referendums, he is still holding unto power with the support of a corrupt police infiltrated by armed gang members. The country is held hostage by factions of armed gangs entrenched throughout the country. According to Article 134-a of our Constitution, the president’s term in office is 5 years. However, Article 134-b made it clear that, the term of any president ends on February 7 which concludes 5 years following the national elections. With the clarification paragraph brought in by the Article 134-b, the number of years in office becomes irrelevant as long as the process is respected, allowing a new president to take office in February 7 and so on. It is therefore a clear violation of our Constitution when the former president insists on holding on to power giving himself an extra year clearly in violation of the Constitution. Mr. President, the torment endured due to police abuse is unbearable. Along with that, there are daily countless cases of kidnapping by these gangs which burden distressed family members with heavy ransoms. These hurdles are causing the carnage of our people as well as the downfall of the democratic system in Haiti. And all this is taking place under the purview of the US Ambassador, Michele J. Sison, and the UN special representative Helen Meagher La Lime, who are seemingly supporting a defect-president on the verge of instilling and imposing a dictatorship in our country. To assert his will, the former president Jovenel Moise has already eliminated other branches of government including the judicial and legislative, thus, governing the country by decree. Faced — 12 —
KINAM MAGAZINE — FEBRUARY | MARCH 2021 with such a situation, the people have expressed their frustration through peaceful but massive protests on the streets throughout the country. These peaceful protests are savagely put down by the police shooting at protestors with tear gas, and live munitions resulting in fatalities. Sir, the US and Haiti have shared quite a long history side by side. As the leader of a sovereign country yourself, we trust that you are able to share our view that Haiti, as a sovereign state, should do much better on the road of democracy without any hinderance. And it is in that regard that, on behalf of Haiti and the Haitian People, I am asserting that, Haiti and the Haitian people would be very appreciative if your administration would look at the facts with respect to our plea vis-à-vis of our Constitution and stop all support aimed at enabling the former Haitian president, Mr. Moise, to remain in office. Haiti, for a long time now, has become a place where daily subsistence has become misery for the majority and enrichment by the minority. Because of abuse and mismanagement, the country is in turmoil, not to mention, mass-assassinations and political corruption. The Justice system needs to be revamped to bring to justice, members of former and present Haitian Governments to recover billions of dollars stolen from our country. Action is badly needed and is impossible under the illegitimate Moise Government. Mr. President, Haiti and the Haitian people are counting on your kind support. Respectfully yours, Serge M.
