completion of works to the Waste Water treatment Plant, craiova
anul 1988, dar s-au sistat din cauza lipsei fondurilor. Au fost
reluate în 1999, dar se impunea respectarea procedurilor europene,
astfel prin sprijinul acordat de UE prin programul ISPA, lucrările au
fost demarate în iulie, 2003, în baza unui contract de Proiectare şi
Construcţie din cadrul măsurii ISPA încheiat cu contractorul
Consorţiul TME Termomecanica Ecologia Sp.A Italia/Silec Sp.A..
Contractul a fost ulterior reziliat în octombrie 2006 de către
Autoritatea Contractantă, din cauza progresului slab înregistrat
de contractorul Consorţiul TME Termomecanica Ecologia Sp.A
Italia/Silec Sp.A. La momentul rezilierii contractului, valoarea contractului
reziliat a fost de 7.060.508,24 €. In urma procesului
castigat, s-a recuperat garantia de buna executie in valoare de
2.454.054,5 €.
Ulterior, în urma procesului de licitaţie derulat în perioada
noiembrie 2006-aprilie 2007, a fost desemnat câştigător constructorul
reprezentat de Consorţiul SISTEM YAPI din Turcia si EMIT din
Italia. Contractul a fost semnat pe data de 26.10.2007.
Bugetul alocat acestei lucrări se ridică la valoarea de
25.996.214,13€.
Ca urmare a neîndeplinirii obligaţiilor ce-i reveneau, a
lipsei unui suport financiar adecvat din partea firmei SISTEM YAPI
INSAAT VE TICARET Turcia în vederea accelerării lucrărilor din
cadrul acestui contract, dar şi datorită declarării falimentului firmei
SISTEM YAPI INSAAT VE TICARET Turcia, în data de 3 iunie
2010 de către Curtea Comercială din Kadikoy, Turcia, şi în conformitate
cu Articolul 8.7 din Acordul de Consorţiu, celălalt partener
al Consorţiului, firma EMIT - Ercole Marelli Impianti Tecnologici
S.p.A., Italia, a decis să preia toate obligaţiile şi responsabilităţile
contractuale ale Consorţiului până la finalizarea Contractului.
Subcontractori ai EMIT au fost: MITLIV, SFERA, CIROMAT,
ELPREST, EUROMAGNUM,NOVAEDIL,TRANSFORMER,STEEL
CONSTRUCT, HOLCIM, SHOBAS.
2. PROVENIENTA

Contractele de lucrări prevăzute în acest Proiect au fost
finanţate prin Programul ISPA(Instrument Structural pentru Politici
de pre-Aderare) cu 75% - contribuţia UE, diferenţa de 25% fiind
constituită de co-finanţarea Consiliului Local Craiova prin împrumut
de la BEI (Banca Europeană de Investiţii).
Bugetul alocat acestui contract de lucrări prin Programul
ISPA a fost de 25.996.214,13 €, din care, conform schemei de fioriginally

to be respected, thus, with the support of the EU, by means of the
ISPA funds, the works started in July 2003 on the basis of a contract
for Design and Construction of the ISPA measure with the consortium
contractor TME Termomecanica Ecologia Sp.A Italia/Silec
Sp.A. The contract was subsequently terminated in October 2006,
by the Contracting Authority because of the poor progress made
by the contractor TME Termomecanica Ecologia Sp.A Italia/Silec
Sp.A. At the moment of the contract termination, its value was
7,060,508.24 € and as a result of a successful law suit, the Contracting
Authority recovered performance bond worth 2454054.5
€.
Later, following the auction process during November
2006 - April 2007, the consortium from SYSteM Yapi manufacturer
in turkey and eMIt from Italy were designated as winners.
The contract was signed on October 26 th , 2007.
The budget assigned to this project work amounts to
25,996,214.13 €.
However, as a result of the failure to perform obligations,
the lack of adequate financial support from the company System
Yapi Insaat ve Ticaret from Turkey and slow evolution of the work
under this contract, but also because of company bankruptcy of
System Yapi Insaat ve Ticaret, Turkey, declared on June 3 rd 2010
by the Commercial Court in Kadikoy, Turkey, and according to
Article 8.7 of the Consortium Agreement, the other partner of the
consortium company EMIT - Ercole Marelli Impianti Processing
SpA, Italy, decided to take over all contractual obligations and responsibilities
of the Consortium to complete the Contract.
The EMIT subcontractors are: MITLIV, SFERA, CIRO-
MAT, ELPREST, EUROMAGNUM, NOVAEDIL, TRANSFORMER,
STEEL CONSTRUCT, HOLCIM, SHOBAS.
2. FUNDS
ALLOCATION
The work contracts in this Project were financed by ISPA
(Instrument for Structural Policies for Pre-Accession Treated)
with 75% EU contribution, the difference of 25% being made up
of the co-financing of The Local Council, Craiova through a loan
from EIB Bank - European Investment Bank).
The budget allocated to the contract works through the
ISPA Program was of 25,996,214.13 € of which, according to the
