Allgemeine Mietbedingungen des Servicepartners der Koelnmesse

1. Alle Preise sind Nettopreise, auf die die Mehrwertsteuer in der gesetzlich
festgesetzten Höhe ausgewiesen wird und zu entrichten ist. Ausländische Unternehmen
sind ab 01.01.1985 umsatzsteuerpflichtig. Auf Antrag wird diese
Umsatzsteuer vom Bundesamt für Finanzen erstattet. Die Preise verstehen
sich frei Anlieferung und Abholung am Messestand. Dies gilt für alle Messeorte,
die im Rahmen unserer Verpflichtungen regelmäßig bedient werden. Für Extralieferungen,
große Distanzen und Auslandslieferungen mit Zollabwicklung
etc. müssen von Fall zu Fall Sonderkonditionen vereinbart werden.
2. Der Mietpreis gilt für die gesamte Dauer der Veranstaltung. Für längere
Mietdauer werden Sonderkonditionen vereinbart. Ein Rücktritt seitens des
Mieters ist nur bis spätestens 14 Tage vor Beginn der Veranstaltung zulässig.
Bei späterem Rücktritt wird die volle Mietgebühr erhoben. Das Mietgut wird
nur für die vereinbarte Zeit, d.h., die Dauer der Veranstaltung, zur Verfügung
gestellt.
3. Die Haftung des Ausstellers für das Leihgut beginnt mit Anlieferung an
den Messestand und endet mit der Abholung. Dies gilt auch, wenn der Stand
nicht besetzt ist. Die Mietmöbel sind bei Veranstaltungsschluss abholfertig
und komplett (inkl. Gitterroste und Gemüseschalen) bereitzustellen und auf
keine Fall in den Kabinen einzuschließen. Falls der Zugriff auf unser Eigentum
nach Veranstaltungsschluss vertragswidrig nicht gewährleistet ist, d. h., dass
die geliehenen Gegenstände eingeschlossen sind, haftet der Aussteller unbegrenzt
und ist verpflichtet, die Gegenstände sicherzustellen und an den Vermieter
spesenfrei zurückzugeben. Das Leihgut ist nicht versichert. Der Abschluss
einer Diebstahlversicherung ist daher unbedingt erforderlich.
4. Eine Reklamation seitens des Mieters muss innerhalb von 24 Stunden erfolgen.
Spätere Beanstandungen werden nicht anerkannt. Andererseits ist der
Mieter verpflichtet, bei Beschädigungen des Mobiliars durch ihn oder Dritte,
Anzeige zu erstatten. Das gleiche gilt ebenso für den Fall eines Diebstahls.
Der Vermieter behält sich vor, in Ausnahmefällen dem Mieter anstelle der bestellten
Möbel gleichwertiges Mobiliar in der entsprechenden Preisklasse zur
Verfügung zu stellen. Im Übrigen gilt dies auch bei verspätet eingehenden Bestellungen.
5. Das Mietmobiliar ist und bleibt Eigentum des Vermieters und ist unpfändbar.
Es dient nur dem vorgesehenen Zweck auf der jeweiligen Veranstaltung.
Eine anderweitige Verwendung in dem gleichen Zeitraum oder im Anschluss
daran ist unstatthaft. Ein Verbringen der Mietgegenstände an einen anderen
Platz (Messestand) oder Ort ist unverzüglich anzuzeigen, da bei Verlust der
Mieter haftbar gemacht werden muss. Das gleiche gilt bei Verladen durch
vom Aussteller beauftragte Messebauer, Standgestalter, oder ähnliche Unternehmen.
Falls Fremdfirmen den Gerätetransport übernehmen sind diese für
alle Schäden am Leihgut (Beschädigung, Verlust, etc.) haftbar.
6. Bei der Aufstellung von Kühl-, und Tiefkühlmöbeln ist zu beachten, dass
diese genügend Luftzufuhr erhalten. Einbau und Verkleidung der Geräte, sowie
Abdecken der Lüftungsschlitze muss vermieden werden. Für Kühl- und Tiefkühlmöbel
ist ein Nachtstromanschluss erforderlich. Das regelmäßige Entleeren
der Tauwasserbehälter ist sicherzustellen. Der Vermieter übernimmt keine
Haftung für Tauwasserschäden. Nach Veranstaltungsschluss ist das Kühlgut
aus den Geräten rechtzeitig zu entnehmen. Bei Abholung werden die darin
noch enthaltenen Getränke und Waren auf die Gefahr des Mieters am Stand
abgestellt. Jegliche Haftung seitens des Vermieters für deren Abhandenkommen
ist ausgeschlossen. Jede Haftung der Firma Valentin Internationaler
Messeservice GmbH & Co. KG für Schäden an Kühlgut, Betriebsausfall, entgangenen
Gewinn usw. ist ausgeschlossen.
7. Für alle Bestellungen, auch für telefonisch, per Fax, e-Mail, oder mündlich
erteilte Aufträge, gelten in jedem Falle die Allgemeinen Miet- und Geschäftsbedingungen.
8. Als Gerichtsstand wird Köln vereinbart. Soweit zulässig vereinbaren die Parteien
Deutsches Recht.

1. All prices are net prices. VAT is listed separately at the appropriate rate and
must be paid. Since 1st January 1985, all foreign companies are subject to VAT
Taxes will be reimbursed by the German Revenue upon request. Prices include
delivery to and pickup from the trade fair stand. This applies to all trade fair
locations that are regularly served as part of our service programme. Extra
deliveries, deliveries over large distances and deliveries abroad requiring
customs clearance are subject to special terms on a case by case basis.
2. The rental fee covers the entire duration of the fair. For longer rental periods,
special conditions can be arranged. Rental cancellations can only be made up
to 14 days prior to the beginning of the fair. The entire rental fee will be charged
for late cancellations. The leased goods are avai-lable only for the agreed
time – i.e. for the duration of the event.
3. The exhibitor’s liability for rental equipment will begin upon delivery to the
stand and will end with the rental equipment collection. These terms apply
even if the stand is unmanned. The complete rental equipment must be prepared
for collection (including shelves, vegetable trays, etc.) and under no circumstances
locked up on the collection date. In the event that our property is not
available at the end of the event, contrary to rental agreement – i.e. the
leased goods are locked up, the exhibitor’s liability is continued indefinitely. In
this case, it is the exhibitor’s obligation to ensure the safety of the goods, which
it must return at its own expense. The rental equipment is not insured. It is the
responsibility of the lessee to provide insurance.
4. Complaints made by the lessee must be submitted within 24 hours of receipt
of rental equipment. Later claims will not be accepted. The lessee is obligated
to report any damage to the equipment caused by the lessee or a third party.
This also applies in the case of theft. The lessor reserves the right to replace the
merchandise with equivalent merchandise in the corresponding price class in
exceptional cases. This also applies to late orders.
5. The rented equipment remains the property of the lessor and is not subject to
seizure. It can be used only for the intended purpose at the corresponding
event. Any different or extended use is not allowed. The lessor must be notified
of any transfer of rental equipment to other locations. Failure to do so will
result in the lessee accepting all liability in the case of loss. This applies to any
damages caused by stand construction companies or similar firms contracted
by the exhibitors. If any other companies transport the appliances, they will
assume all liability for damages and losses of rental equipment.
6. Adequate ventilation must be provided when setting up refrigeration and
deep-freeze equipment. Covering the devices, fitting them in confined spaces
or covering the cooling vent slits of the equipment must be avoided. For refrigerated
and deep-freeze equipment a connection guaranteeing power during
the night is essential. The defrosting containers must be emptied regularly. The
lessor is not liable for any water damages. Any fridge or freezer contents must
be removed at the end of the event. When a device is collected, any drinks or
other products it contains will be left on the stand at the lessee's risk. The rental
company Valentin Internationaler Messeservice GmbH & Co. KG is not liable for
the disappearance of such products. The rental company Valentin Internationaler
Messeservice GmbH & Co. KG is not liable for any damages to the refrigerated
merchandise, failures of the equipment, or loss of profit.
7. The General Terms and Conditions of Business and Rental apply to all orders
whether verbal, telephoned, faxed, e-mailed or written.
8. The place of jurisdiction is Cologne, Germany. The parties agree to abide by
German laws insofar as these are applicable.
