WHEREAS A.F.T. Limited (hereinafter called "the<br />
company") is the management company within<br />
the meaning of section 76 of the Companies Act,<br />
1961-1971 in relation to a trust deed (hereinafter<br />
called "the Deed") constituting the A.F.T. Equity<br />
Growth Trust; and whereas application has been<br />
made by the company for exemption from compliance<br />
with certain provisions of Division 5 of<br />
Part IV of the said Act in respect of the deed:<br />
Now, therefore, I, the undersigned, the Minister<br />
administering the said Act, do hereby exempt the<br />
company from complying with the provisions of<br />
subsection (1) of section 84 of the said Act on<br />
the condition that the company<br />
(a) keeps or causes to be kept in The Australian<br />
Capital Territory a complete register<br />
of interest holders wheresoever<br />
resident at a place and in the form and<br />
manner in which such a register would<br />
be required to be kept if the Deed were<br />
an approved deed under the law of The<br />
Australian Capital Territory relating to<br />
companies; and<br />
(b) keeps at a place within three miles of<br />
of the office of the Registrar of Companies<br />
in the <strong>State</strong> of Western Australia, a<br />
register of interest holders resident in<br />
Western Australia and in relation to that<br />
register complies with the requirements<br />
of section 84 of the said Act, and at such<br />
place provides reasonable accommodation<br />
and facilities for persons to inspect and<br />
take copies of that register; and<br />
(c) within fourteen days of the date upon<br />
which a request in that behalf is delivered<br />
to or served upon the company<br />
or made at its registered office in the <strong>State</strong><br />
of Western Australia or at the place referred<br />
to in paragraph (b) hereof, makes<br />
a copy of the register, referred to in paragraph<br />
(a) hereof, available thereat to<br />
any holder of interests in the trust without<br />
charge and to any other person on<br />
payment of a sum not exceeding fifty<br />
cents as the company may require.<br />
