COMPANIES ACT, 1961-1971.
WHEREAS A.F.T. Limited (hereinafter called "the
company") is the management company within
the meaning of section 76 of the Companies Act,
1961-1971 in relation to a trust deed (hereinafter
called "the Deed") constituting the A.F.T. Equity
Growth Trust; and whereas application has been
made by the company for exemption from compliance
with certain provisions of Division 5 of
Part IV of the said Act in respect of the deed:
Now, therefore, I, the undersigned, the Minister
administering the said Act, do hereby exempt the
company from complying with the provisions of
subsection (1) of section 84 of the said Act on
the condition that the company
(a) keeps or causes to be kept in The Australian
Capital Territory a complete register
of interest holders wheresoever
resident at a place and in the form and
manner in which such a register would
be required to be kept if the Deed were
an approved deed under the law of The
Australian Capital Territory relating to
companies; and
(b) keeps at a place within three miles of
of the office of the Registrar of Companies
in the State of Western Australia, a
register of interest holders resident in
Western Australia and in relation to that
register complies with the requirements
of section 84 of the said Act, and at such
place provides reasonable accommodation
and facilities for persons to inspect and
take copies of that register; and
(c) within fourteen days of the date upon
which a request in that behalf is delivered
to or served upon the company
or made at its registered office in the State
of Western Australia or at the place referred
to in paragraph (b) hereof, makes
a copy of the register, referred to in paragraph
(a) hereof, available thereat to
any holder of interests in the trust without
charge and to any other person on
payment of a sum not exceeding fifty
cents as the company may require.
