WHEREAS it is, inter alia, provided by subsection (3) of section 10 of the Local Government Act, 1960-1971, that when a district of a shire is divided into wards the number of offices of member for each ward in such as from time to time is declared by Order; and whereas it is expedient that the number of offices of member in certain wards of the Shire of Esperance be altered: Now, therefore, His Excellency the Governor acting by and with the advice and consent of the Executive Council, doth hereby declare that on and from the fourth Saturday in May 1973 the number of offices of member in the respective wards in the Shire of Esperance shall be as follows:- Esperance Ward-7. WHEREAS the Council of the Shire of Roebourne is desirous, under the By-law making power conferred by section 193 of the Local Government Act, 1960, of making By-laws for regulating public bathing, and the costumes of bathers and the conduct of bathers and others in the sea though outside its district for a distance of two hundred (200) yards from low water mark at ordinary spring tides; and whereas it is enacted by subparagraph (iv) of paragraph (a) of that section, that such By-laws may be made only pursuant to an order made under subsection (8) of section 190 of the Act; and whereas it is enacted by the subsection lastmentioned that where in the opinion of the Governor a By-law making power conferred by the Act on a Council should be extended to areas which are outside the district, the Governor may by Order declare that for the purpose of the exercise of the power the areas are to be regarded as being within the district and that the Council may exercise the power in respect of the areas as if in fact they were within the district; and whereas the Governor is of the opinion that the said Bylaw making power should be extended to the said areas outside the district of the said Council: Now, therefore, His Excellency the Governor, pursuant to the powers conferred by subsection (8) of section 190 of the Local Government Act, 1960, and acting by and with the advice and consent of the Executive Council, doth hereby declare that for the purpose of the exercise of the said By-law making power areas which are outside the district of the Shire of Roebourne, namely areas which adjoin that district and extend for a distance of two hundred (200) yards seaward from low water mark at ordinary spring tides are to be regarded as being within the district of the Shire of Roebourne, and that the Council of the Shire of Roebourne may make By-laws for regulating public bathing and the costumes of bathers and the conduct of bathers and others in respect of those areas as if in fact they were within the municipal district of the Shire of Roebourne. W. S. LONNIE, Clerk of the Council. Explosives and Dangerous Goods Act, 1961-1967. ORDER IN COUNCIL. WHEREAS it is enacted, inter alia, by section 14 of the Explosives and Dangerous Goods Act, 1961- 1967, that the Governor may from time to time by Order in Council, classify explosives and declare any specified explosive to be an authorised explosive for the purposes of that Act and that the Governor shall not so classify or declare any explosive until the Chief Inspector has defined the composition, quality and character of that explosive; but such definition in respect of the explosive is not required to be published in the Order in Council classifying that explosive; and whereas it is further enacted that an Order in Council made under the said section may be cancelled or from time to time varied by a subsequent Order in Council; and whereas the Chief Inspector has defined the composition, quality and character of the explosive hereinafter mentioned and it is now expedient that the Order in Council made by the Lieutenant-Governor on the 22nd day of July, 1964, be varied accordingly: Now, therefore, His Excellency the Governor acting with the advice and consent of the Executive Council and in exercise of the powers aforesaid, doth hereby vary the abovementioned Order in Council by adding under the heading "CLASS 6—AMMUNITION. Division 1." in the Schedule to that Order, the item Ramset RP-4 Pellets (X) and declare this item to be an authorised explosive for the purposes of the said Act, with effect from and including the day of publication of this Order in the Government Gazette.
