4) Second Positive Test<br />
An employee who has a second positive alcohol or drug test, after a previous positive<br />
drug or alcohol test, is subject to immediate termination.<br />
5) Refusal to Test<br />
Any kind of refusal to take a required drug or alcohol test will result in termination<br />
under UTA policy. See section 1.04 regarding compliance with testing.<br />
Article III. ADDITIONAL REQUIREMENTS FOR SAFETY-SENSITIVE<br />
EMPLOYEES<br />
The following policies apply to safety-sensitive employees <strong>and</strong> are in addition to <strong>the</strong> FTA<br />
requirements as explained in <strong>the</strong> Board approved Drug <strong>and</strong> Alcohol Policy. [See EXHIBIT<br />
1 for a list of UTA safety-sensitive jobs, <strong>and</strong> EXHIBIT 2 for a comparison on <strong>the</strong> FTA<br />
requirements vs. <strong>the</strong> UTA requirements.]<br />
Section 3.01 Reporting of Prescribed Drugs<br />
In <strong>the</strong> interest of protecting employees <strong>and</strong> o<strong>the</strong>rs, safety-sensitive employees must make<br />
sure that any prescribed drug or any combination of drugs being taken will not adversely<br />
impact <strong>the</strong>ir job performance. The prescribing physician must approve <strong>the</strong> medications to<br />
ensure that <strong>the</strong> employee’s job duties can be performed safely. This approval must be<br />
reported in writing to UTA. Employees can obtain a Medication Approval Form from <strong>the</strong><br />
Human Resources department, supervisors, or from Office Coordinators to make this<br />
report.<br />
(A) Prescribed Drugs That Need Not Be Reported<br />
Drugs on <strong>the</strong> Medication Approval Form listed under <strong>the</strong> section titled “DRUGS<br />
WHICH NEED NOT BE REPORTED” do not need to be reported, whe<strong>the</strong>r taken<br />
alone or in combination with o<strong>the</strong>r drugs that do not need to be reported. This<br />
includes antibiotics, birth control pills, vitamins, local dental injections, creams,<br />
ointments, <strong>and</strong> lotions. When using a drug that does not need to be reported, it is<br />
<strong>the</strong> employee’s responsibility to make sure that <strong>the</strong> drug taken is exactly <strong>the</strong> same as<br />
<strong>the</strong> drug on <strong>the</strong> list. (See Exhibit 4 for a list of <strong>the</strong>se drugs.)<br />
(B) Prescribed Drugs that Must be Reported<br />
Safety-sensitive employees must report prescribed drugs listed under <strong>the</strong> section of<br />
<strong>the</strong> Medication Approval Form titled “MANDATORY REPORTABLE DRUGS,<br />
WITH RESTRICTIONS,” or any o<strong>the</strong>r drug that is not listed on <strong>the</strong> form. When<br />
reporting prescribed drugs, all o<strong>the</strong>r prescribed drugs being taken at <strong>the</strong> same time<br />
must also be approved <strong>and</strong> reported. (See Exhibit 4 for a list of <strong>the</strong>se drugs.)<br />
