work. As with a prescription medication, employees are to convey <strong>the</strong> form 1C1 when used in<br />

this application to <strong>the</strong>ir supervisor to explain <strong>the</strong>ir absence. Also, <strong>the</strong> form will be acceptable in<br />

lieu of having <strong>the</strong> “Physician’s Section” of <strong>the</strong> st<strong>and</strong>ard sick leave application completed.<br />

5.3 Using over-<strong>the</strong>-counter medication.<br />

6. DISCIPLINE<br />

5.3.1 Ultimately, <strong>the</strong> employee may be <strong>the</strong> best judge of how a substance is impacting him/her. As<br />

such, <strong>the</strong> employee has <strong>the</strong> responsibility to refrain from using any over-<strong>the</strong>-counter medication<br />

that causes performance altering side effects, whe<strong>the</strong>r or not <strong>the</strong> label warns of <strong>the</strong>m. The atwork<br />

employee is to contact his/her supervisor for relief from safety-sensitive duties <strong>and</strong> seek <strong>the</strong><br />

assistance of his/her physician in selecting an alternative treatment.<br />

6.1 A safety-sensitive employee who violates this policy is to be removed from service immediately.<br />

6.2 Violation of this policy will subject an employee to disciplinary action up to <strong>and</strong> including termination of<br />

employment.<br />

6.3 Once removed from service under 6.1 above, an employee may not be returned to safety-sensitive duties<br />

until evaluated <strong>and</strong> released by an MTA physician. Release to work may involve participation in <strong>the</strong> MTA<br />

Rehabilitation Program.<br />

NOTE: An employee who self-reports a problem with <strong>the</strong> abuse of Rx or OTC medications or o<strong>the</strong>r<br />

substances that have performance altering effects in violation of this policy prior to reporting to work will<br />

be referred to <strong>the</strong> MTA Substance Abuse Professional for rehabilitation assistance without incurring<br />

disciplinary action.<br />
