Appendix F: Complaints 2003–04 Nature of Complaint Result Complaints made to the NCA during 2002 A person complained that an ACC investigator had made threats to other persons. Complaints made to the ACC during 2003 A solicitor complained that an ACC investigator had ignored his client’s right to obtain a lawyer. A person complained that crucial evidence had been erased from a tape made during an NCA investigation in 1997, and tendered in a prosecution. A person alleged that the ACC had breached its own secrecy provisions. Complaints made to the ACC in 2003–04 A person raised a number of concerns regarding the ACC’s handling of complaints and merit selection processes. A person provided information regarding alleged corruption of NCA offi cers in SA. Investigation of the complaint found it to be unsubstantiated. This matter was referred to the Ethical Standards Command of Queensland Police Service for investigation. Investigation of the complaint found it to be unsubstantiated. The trial judge accepted expert evidence in relation to the tape. The complainant was found guilty by the jury. Nature of Complaint Result A confi dential informer provided information that an ACC offi cer had acted corruptly. A person provided information that another person was being protected by an offi cer of the ACC. An ACC offi cer raised a complaint against an investigator regarding the investigator’s integrity. A person complained to the Commonwealth Ombudsman about the return of property from the ACC. A person complained to the ACC about the possible misconduct of an ACC staff member. A person wrote to the ACC regarding irregularities in a selection process. The informer did not provide suffi cient information to substantiate the allegation. This matter was referred to the NSW Police Integrity Commission and the NSW Police Commissioner for investigation. The investigation is ongoing. This matter was referred to the Victoria Police Ethical Standards Department for investigation. It has been joined with the above NSW Police Integrity Commission investigation. The investigation is ongoing. All property held by the ACC has been returned to the complainant’s solicitor. The matter was investigated internally.
