Appendix H: Other Mandatory Information Environment Protection and Biodiversity Conservation Act 1999 This statement is made in accordance with s 516A of the Environment Protection and Biodiversity Conservation Act 1999. The ACC is committed to the Government program aimed at reducing energy consumption. ACC buildings have timer-controlled air conditioning and lighting to reduce energy consumption out of hours. Waste management initiatives, such as the recycling of paper and other consumable, have been implemented. The ACC does not undertake any activities that are relevant to ecologically sustainable development. Discretionary Grants The ACC received no discretionary grants in 2003–04. There were no material errors in the ACC’s 2002–03 <strong>Annual</strong> <strong>Report</strong>. Advertising and Market Research Section 311A of the Commonwealth Electoral Act 1918 requires agencies to report particulars of all amounts paid by, or on behalf of the ACC during the financial year for advertising and market research. During 2003–04, the ACC paid the following amounts to media advertising agencies for recruitment advertising: HMA Blaze: $178,009 Beeley Callan Euro: $35,957 Engagement of Consultants and Counsel The ACC engages consultants for the provision of professional or expert advice or for services that cannot be met through internal resources. Consultants are selected in accordance with Commonwealth procurement guidelines and the ACC Chief Executive’s Instructions. Approval to engage consultants rests with the CEO as set out in section 48 of the ACC Act. A list of consultants engaged and/or paid in 2003–04 at a cost of more than $10,000 is at Appendix C. While the ACC does not undertake prosecutions, it frequently requires legal representation in cases where an investigation leads to prosecution or where the ACC is otherwise involved in a case. In addition, the ACC is occasionally the respondent in legal proceedings arising from legal challenges by people who have been summonsed to appear at a hearing before the ACC. In such cases independent legal counsel represent the ACC. Where appropriate the ACC also engages independent counsel to assist the ACC in the conduct of hearings. 156 I ACC ANNUAL REPORT 2003–04
Commonwealth Disability Strategy The ACC has from its inception adhered to the principles of equity and access for people with disabilities. Until a formal policy is fully implemented in 2004–05, the ACC remains committed to the Commonwealth Disability Strategy. Occupational Health and Safety The ACC Occupational Health and Safety (OH&S) Handbook outlines the roles and responsibilities of staff and management. Each operational centre has an active local committee that identifies and addresses issues relating to health and safety. The OH&S policy was developed in consultation with staff and sets out the OH&S roles and responsibilities of management and staff. The ACC was not required to give any notices under section 68 of the Occupational Health and Safety (Commonwealth Employment) Act 1991 during the year.
