ACC Board-Strategic Direction Committee The terms of reference for the ACC Board Strategic Direction Committee (SDC), established by the ACC Board on 13 May 2003, were varied at its 22 September meeting. The committee comprises the Commissioner AFP (as Chair), the Chief Police Officer of the Australian Capital Territory, the NSW Police Commissioner and the CEO ACC (non-voting). The committee’s role as revised is to: ‘assist and advise the CEO on matters relevant to the implementation of ACC Board- approved strategic directions and priorities and report to the ACC Board accordingly. When appropriate, the committee shall make recommendations to the ACC Board for support to the ACC and shall undertake such other functions as specified by the ACC Board from time to time.’ The SDC held six meetings in the reporting period and noted the encouraging progress the ACC had made since its inception. The SDC agreed that the ACC Board should be asked to provide feedback on the value of ACC intelligence products. It also reviewed the proposed ACC operational priorities and conceptual framework for proposed ACC authorisations and Determinations for 2004–05. Parliamentary Joint Committee on the ACC The Parliamentary Joint Committee on the ACC (PJC) is made up of members of both the Senate and the House of Representatives. Its role is to monitor and review the performance of the ACC. It reports to both Houses of the Commonwealth Parliament on any matter relevant to the ACC or the performance of its functions. Its membership, powers and functions are set out at sections 53-55 of the ACC Act. In 2003, the PJC held an inquiry into the ACC’s role in the cybercrime environment. The ACC and other agencies and individuals provided submissions to the inquiry and attended hearings held in July 2003. The committee’s report was finalised in March 2004 and the Government’s response will soon be finalised. In 2003 and 2004, the PJC held an inquiry into trafficking in women for sexual servitude. The CEO also briefed the PJC on corruption allegations on 24 June 2004. This relates to alleged criminal activity by two former employees being investigated by the Commonwealth Ombudsman, NSW Police Integrity Commission and Victorian Police Ethical Standards Department. The Ombudsman may advise the ACC of complaints it has received but is not required to do so. The Ombudsman advised the ACC of two complaints he had received and is investigating. During 2003–04 the Ombudsman and the ACC fi nalised arrangements for the referral and investigation of complaints. The Ombudsman is also required to report to the PJC on the ACC’s use of controlled operations and to monitor the ACC’s compliance with telecommunications interception (TI) legislation. Hon Bruce Baird MP On June 29, 2004, the Ombudsman released an own motion investigation into a review of the operational and corporate implications for the ACC, arising from alleged criminal activity by two former secondees. The report made a number of recommendations, all of which were accepted by the ACC. The ACC has moved to implement these recommendations as a matter of organisational priority.
