6. Strategic options and recommendations<br />

Introduction<br />

We have divided our discussion <strong>of</strong> strategic options <strong>for</strong> <strong>the</strong> <strong>UK</strong> Film Council into two sections:<br />

• options related to rights issues<br />

• options related to distribution.<br />

It is important to stress that <strong>the</strong>se two areas are highly interdependent and also that <strong>the</strong> options presented here are not mutually<br />

exclusive. Thus, <strong>for</strong> example, it is likely that prior to intervention in <strong>the</strong> distribution market, significant issues surrounding rights and<br />

content access would have to be resolved. Likewise, some <strong>of</strong> <strong>the</strong> interventions that alone could be seen as easing friction in <strong>the</strong> rights<br />

market may also be necessary prior to launch embarking on one <strong>of</strong> <strong>the</strong> distribution options described below.<br />

None<strong>the</strong>less, if <strong>the</strong> <strong>UK</strong> Film Council decides that its best course <strong>of</strong> action is to act as a facilitator only or simply to seed <strong>the</strong> market <strong>for</strong> an<br />

unrelated commercial entity to take over set-up and running <strong>of</strong> <strong>the</strong> digital plat<strong>for</strong>m that results, it may wish to only undertake <strong>the</strong> earlier<br />

stage projects suggested in sections one and two <strong>of</strong> this discussion.<br />

None <strong>of</strong> <strong>the</strong> strategic options assume that <strong>the</strong> <strong>UK</strong>FC itself should necessarily be taking on <strong>the</strong> particular functions described. Ra<strong>the</strong>r <strong>the</strong>y<br />

could be franchised out to third-party commercial operators or o<strong>the</strong>r public agencies.<br />

Strategic options in relation to rights<br />

Within <strong>the</strong> area <strong>of</strong> rights issues, we have divided potential kinds <strong>of</strong> intervention by <strong>the</strong> <strong>UK</strong> Film Council into three broad categories:<br />

1. Clarifying rights issues<br />

2. Easing friction in <strong>the</strong> market<br />

3. Commercial intervention in <strong>the</strong> market<br />
