option, and where the local authority having jurisdiction permits, BellSouth shall<br />

provide an AC power source and access to physical Collocation services and<br />

facilities, subject to the same nondiscriminatory requirements as those applicable to<br />

any other physical Collocation arrangement. In Alabama and Louisiana, at OTI’s<br />

request and expense, BellSouth will provide DC power to an Adjacent Collocation<br />

site where technically feasible, as that term has been defined by the FCC, and in<br />

accordance with applicable law. BellSouth will provide DC power in an Adjacent<br />

Arrangement provided that such provisioning can be done in compliance with the<br />

National Electric Code (NEC), all safety and building codes, and any local codes,<br />

such as, but not limited to, local zoning codes, and upon completion of<br />

negotiations between the Parties on the applicable rates and provisioning intervals.<br />

OTI will pay for any and all DC power construction and provisioning costs to an<br />

Adjacent Arrangement through individual case basis (ICB) pricing that must be<br />

paid as follows: fifty percent (50%) before the DC installation work begins and<br />

fifty percent (50%) at completion of the DC installation work to the Adjacent<br />

Arrangement. OTI’s BellSouth Certified Supplier shall be responsible, at OTI’s<br />

sole expense, for filing the required documentation to obtain any and all necessary<br />

permits and/or licenses for an Adjacent Arrangement. BellSouth shall allow<br />

Shared Caged Collocation within an Adjacent Arrangement, pursuant to the terms<br />

and conditions set forth in Section 3.3 above.<br />

3.5 Direct Connect<br />

3.5.1 BellSouth will permit OTI to directly interconnect between its own physical/virtual<br />

Collocation Spaces within the same BellSouth central office (Direct Connect).<br />

OTI shall contract with a BellSouth Certified Supplier to place the Direct Connect,<br />

which shall be provisioned using facilities owned by OTI. A Direct Connect shall<br />

utilize BellSouth common cable support structure. There will be a recurring<br />

charge per linear foot, per cable, of the actual common cable support structure<br />

used by OTI to provision the Direct Connect between its physical/virtual<br />

Collocation Spaces. In those instances where OTI’s physical/virtual Collocation<br />

Spaces are contiguous in the central office, OTI will have the option of using<br />

OTI’s own technicians to deploy the Direct Connect using either electrical or<br />

optical facilities between its Collocation Spaces by constructing its own dedicated<br />

cable support structure. OTI will deploy such electrical or optical connections<br />

directly between its own equipment without being routed through BellSouth’s<br />

equipment or common cable support structure. OTI may not self-provision a<br />

Direct Connect on any BellSouth distribution frame, POT Bay, Digital System<br />

Cross-Connect (DSX) panel or Light Guide Cross-Connect (LGX) panel. OTI is<br />

solely responsible for ensuring the integrity of the signal.<br />

3.5.2 To place an order for a Direct Connect, OTI must submit an Initial Application or<br />

Subsequent Application to BellSouth. If no modification to the Collocation Space<br />

is requested other than the placement of a Direct Connect, the Co-Carrier Cross<br />

Connect/Direct Connect Application Fee for Direct Connect, as defined in Exhibit<br />

CCCS 141 of 261
