requested. Where the Subsequent Application does not require provisioning or
construction work, but requires BellSouth to perform an administrative activity, an
Administrative Only Application Fee shall apply as set forth in Exhibit B. The
Administrative Only Application Fee will apply to Subsequent Applications
associated with a transfer of ownership of the Collocation Space, removal of
equipment from the Collocation Space (where the removal requires no physical
work to be performed by BellSouth), an Alteration made to a Bona Fide
application by OTI prior to BellSouth’s receipt of the BFFO, and a virtual-tophysical
conversion (in place). The Co-Carrier Cross Connect/Direct Connect
Application Fee will apply when OTI submits a Subsequent Application for a
direct connection between its own physical and virtual Collocation Space(s) in the
same BellSouth Premises or between its physical or virtual Collocation Space and
that of another collocated telecommunications carrier within the same BellSouth
Premises. The Power Reconfiguration Only Application Fee will apply when OTI
submits a Subsequent Application that reflects only an upgrade or reduction in the
amount of power that BellSouth is currently providing to OTI’s physical
Collocation Space. The fee for a Subsequent Application, for which the Alteration
requested has limited effect (e.g., requires limited assessment and sufficient cable
support structure, HVAC, power and terminations are available), shall be the
Subsequent Application Fee, as set forth in Exhibit B. The appropriate
nonrecurring application fee will be billed on the date that BellSouth provides OTI
with an Application Response.
6.3 Space Preferences. If OTI has previously requested and received a Space
Availability Report for the BellSouth Premises, OTI may submit up to three (3)
space preferences on its application by identifying the specific space identification
numbers referenced on the Space Availability Report for the space it is requesting.
In the event BellSouth cannot accommodate OTI's space preference(s), OTI may
accept the space allocated by BellSouth or cancel its application and submit
another application requesting additional space preferences for the same BellSouth
Premises. This application will be treated as a new application and the appropriate
application fee will apply. The application fee will be billed by BellSouth on the
date that BellSouth provides OTI with an Application Response.
6.4 Space Availability Notification
6.4.1 In Florida, BellSouth will respond to an application within fifteen (15) days as to
whether space is available or not available within a BellSouth Premises.
BellSouth’s e.App system will reflect when OTI’s application is Bona Fide. If the
application cannot be Bona Fide, BellSouth will identify what revisions are
necessary for the application to become Bona Fide.
6.4.2 If the amount of space requested is not available, BellSouth will notify OTI of the
amount of space that is available and no application fee will apply. When
BellSouth’s response includes an amount of space less than that requested by OTI
CCCS 153 of 261
