Schedule 6 — Miscellaneous amendments<br />

69 In section 26 <strong>of</strong> the Landlord and <strong>Tenant</strong> Act 1985 (exception <strong>for</strong> tenants <strong>of</strong><br />

certain public authorities from provisions about limitation on service<br />

charges), in subsection (2)(a), <strong>for</strong> “by re-entry or <strong>for</strong>feiture” substitute<br />

“under the Landlord and <strong>Tenant</strong> (<strong>Termination</strong> <strong>of</strong> <strong>Tenancies</strong>) Act 2006”.<br />

Agricultural Holdings Act 1986 (c. 5)<br />

70 Part 7 <strong>of</strong> the Agricultural Holdings Act 1986 (miscellaneous and<br />

supplemental provisions) is amended as follows.<br />

71 After section 83 insert—<br />

“83A <strong>Termination</strong> action<br />

(1) The application <strong>of</strong> the Landlord and <strong>Tenant</strong> (<strong>Termination</strong> <strong>of</strong><br />

<strong>Tenancies</strong>) Act 2006 to the case <strong>of</strong> an agricultural holding is subject<br />

to this section.<br />

(2) Section 6 (contents <strong>of</strong> tenant default notice) has effect as if in<br />

subsection (6)—<br />

(a) <strong>for</strong> “seven days” there were substituted “six months”, and<br />

(b) <strong>for</strong> “the seventh day after the service day” there were<br />

substituted “the day after the end <strong>of</strong> the period <strong>of</strong> six months<br />

beginning with the service day”.<br />

(3) Section 7 (period <strong>for</strong> making a termination claim) has effect as if in<br />

subsection (2)—<br />

(a) after “start day is” there were inserted “the day after the end<br />

<strong>of</strong> the period <strong>of</strong> two months beginning with”, and<br />

(b) in paragraph (c) the words “the eighth day after” were<br />

omitted.<br />

(4) Section 22 (termination under summary procedure) has effect as if in<br />

subsection (1)(a) <strong>for</strong> “one month” there were substituted “two<br />

months”.”.<br />

72 In section 87 (charges), in subsection (5)—<br />

(a) <strong>for</strong> “or liable to <strong>for</strong>feiture” substitute “(whether under the Landlord<br />

and <strong>Tenant</strong> (<strong>Termination</strong> <strong>of</strong> <strong>Tenancies</strong>) Act 2006 or otherwise)”, and<br />

(b) omit “or <strong>for</strong>feited”.<br />

Landlord and <strong>Tenant</strong> Act 1987 (c. 31)<br />

73 In section 59 <strong>of</strong> the Landlord and <strong>Tenant</strong> Act 1987 (meaning <strong>of</strong> “long lease”,<br />

etc.), in subsection (3)(a), <strong>for</strong> “by re-entry or <strong>for</strong>feiture” substitute “under the<br />

Landlord and <strong>Tenant</strong> (<strong>Termination</strong> <strong>of</strong> <strong>Tenancies</strong>) Act 2006”.<br />

Housing Act 1988 (c. 50)<br />

74 The Housing Act 1988 is amended as follows.<br />

75 After section 7(6) (order <strong>for</strong> possession not to be made in relation to fixedterm<br />

tenancy unless tenancy already makes provision <strong>for</strong> termination on the<br />
