Criminal Justice Act 1991 (c. 53)<br />
78 (1) In subsection (3) <strong>of</strong> section 84 <strong>of</strong> the Criminal Justice Act 1991 (tenancies <strong>of</strong><br />
contracted out prisons), omit paragraph (b).<br />
(2) After that subsection, insert—<br />
“(3A) Where on a termination claim made under the Landlord and <strong>Tenant</strong><br />
(<strong>Termination</strong> <strong>of</strong> <strong>Tenancies</strong>) Act 2006 on the ground <strong>of</strong> a tenant<br />
default in respect <strong>of</strong> a lease or tenancy within subsection (3), the<br />
court is satisfied that the default has occurred—<br />
(a) it must make a termination order, and<br />
(b) sections 9 to 17 <strong>of</strong> that Act are to be read accordingly.<br />
(3B) Section 24 <strong>of</strong> that Act (post-termination orders) does not apply to a<br />
lease or tenancy within subsection (3).”.<br />

79 In section 1(4) <strong>of</strong> the Charities Act 1992 (transfer <strong>of</strong> property under that Act<br />
not to be breach <strong>of</strong> covenant against alienation), <strong>for</strong> “give rise to a <strong>for</strong>feiture”<br />
substitute “be a ground on which termination action may be taken under the<br />
Landlord and <strong>Tenant</strong> (<strong>Termination</strong> <strong>of</strong> <strong>Tenancies</strong>) Act 2006”.<br />

81 The Leasehold Re<strong>for</strong>m, Housing and Urban Development Act 1993 is<br />

82 In section 7 (meaning <strong>of</strong> “long lease”), in subsection (1)(a), <strong>for</strong> “by re-entry,<br />
<strong>for</strong>feiture” substitute “under the Landlord and <strong>Tenant</strong> (<strong>Termination</strong> <strong>of</strong><br />
<strong>Tenancies</strong>) Act 2006”.<br />
83 (1) Schedule 3 (restrictions on participation by tenants where collective<br />
