proposition for the 151 corridor is going to be very involved. It’s going to<br />

involve many property owners and many issues. It may take more than<br />

one <strong>Town</strong> Meeting. And that’s really the concern here, is if you adopt this<br />

rezoning tonight, there would be an immediate benefit to this neighborhood<br />

by having this property and this structure become viable again and <strong>of</strong><br />

economic benefit to the neighborhood and to this corner in particular.<br />

THE MODERATOR: I’ve got a question for Mr. Duffy. Mr.<br />

Duffy, this articular appears to me to be an article that was at a previous<br />

<strong>Town</strong> Meeting. Is this in violation <strong>of</strong> Chapter 40A, Section 5?<br />

MR. DUFFY: Well, Mr. Moderator, Chapter 40A, Section 5, I<br />

just happen to have a copy here, says, “No proposed zoning bylaw which<br />

has been unfavorably acted upon by the <strong>Town</strong> Meeting shall be<br />

considered by the <strong>Town</strong> Meeting within two years <strong>of</strong> the date <strong>of</strong> such<br />

unfavorable action unless the adoption <strong>of</strong> the proposed zoning bylaw is<br />

recommended by the Planning Board.”<br />

Now, the Planning Board has recommended indefinite<br />

postponement here, and this looks to me like a very similar article. So<br />

perhaps someone can explain why it’s different and why it’s even here.<br />

THE MODERATOR: Ms. Moynihan, can you tell us why this<br />

is not in violation <strong>of</strong> the Chapter?<br />
