well as a commissi<strong>on</strong> of $0.05 per barrel. Neither M<strong>on</strong>tega Trading nor its directors ever paid<br />

SOMO the required surcharge <strong>on</strong> the c<strong>on</strong>tract executed with Sopak. 205<br />

2. Imvume Management (Pty) Limited<br />

After the shipping incident, Mr. Majali c<strong>on</strong>tinued to receive oil allocati<strong>on</strong>s through a new<br />

company, Imvume. Because M<strong>on</strong>tega Trading had failed to pay the outstanding surcharges,<br />

SOMO refused to sell oil to Mr. Majali in Phase X. When Mr. Majali complained to Iraqi<br />

officials, SOMO was ordered to allocate oil to Mr. Majali in Phase XI. Imvume managed to<br />

obtain two Iraqi oil c<strong>on</strong>tracts in Phases XI and XII. 206<br />

Prior to the renewal of his oil allocati<strong>on</strong>s, Mr. Majali had been very involved in strengthening ties<br />

between South Africa and Iraq. In September 2001, as Chairpers<strong>on</strong> of both the SAIFA and the<br />

South African Business Council for Ec<strong>on</strong>omic Transformati<strong>on</strong> (“SABCETT”), Mr. Majali led a<br />

South African delegati<strong>on</strong> to Baghdad, which included officials from the South African Strategic<br />

Fuel Fund Associati<strong>on</strong> and South African Department of Minerals and Energy. The delegati<strong>on</strong><br />

was involved in discussi<strong>on</strong>s <strong>on</strong> strengthening ties between the ANC and the Iraq Friendship<br />

Associati<strong>on</strong> and Arab Ba’ath Socialist Party (“Ba’ath Party”), as well as building better oil trade<br />

relati<strong>on</strong>ships between the two countries. Mr. Majali undertook the trip as a recognized<br />

representative of the ANC. In a letter to the Iraq Friendship Associati<strong>on</strong>, Mr. Motlanthe stated<br />

that Mr. Majali’s positi<strong>on</strong> as Chairpers<strong>on</strong> of SAIFA had the ANC’s “full approval and blessing.”<br />

He also c<strong>on</strong>firmed the ANC’s approval of Mr. Majali “as a designated pers<strong>on</strong> to lead the<br />

implementati<strong>on</strong> processes arising out of our ec<strong>on</strong>omic development <strong>programme</strong>s.” 207<br />
