OIL TRANSACTIONS AND ILLICIT PAYMENTS<br />
the surcharge payments <strong>on</strong> the three Glencore and Petrogaz c<strong>on</strong>tracts. For example, between<br />
January and April 2001, Glencore transferred a total of approximately $4.8 milli<strong>on</strong> to Mr. Abu-<br />
Reyaleh’s account at the Arab Bank Geneva. During that time period, approximately $4.0<br />
milli<strong>on</strong> was then wire transferred from Mr. Abu-Reyaleh’s account to SOMO accounts. 295<br />
Between May and September 2001, Glencore transferred a total of approximately $2.1 milli<strong>on</strong> to<br />
Mr. Abu-Reyaleh’s account at the Commercial Bank. During that time period, approximately<br />
$1.9 milli<strong>on</strong> was then transferred from Mr. Abu-Reyaleh’s account at Commercial Bank to a<br />
SOMO bank account for the payment of surcharges <strong>on</strong> the c<strong>on</strong>tracts. 296<br />
With respect to these three c<strong>on</strong>tracts, Glencore’s payments to Mr. Abu-Reyaleh do not appear to<br />
corresp<strong>on</strong>d with the agreed-up<strong>on</strong> commissi<strong>on</strong> of $0.20 to $0.22. The agreement provided that<br />
Mr. Abu-Reyaleh’s company, Al-Khaled Engineering, would receive $0.20 per barrel of oil lifted<br />
under Petrogaz c<strong>on</strong>tracts and $0.22 per barrel under Glencore France c<strong>on</strong>tracts. An analysis of<br />
the Glencore records show that the $0.22 per barrel commissi<strong>on</strong> was paid <strong>on</strong>ly <strong>on</strong> the initial lifts<br />
in the Phase IX c<strong>on</strong>tracts. During this time, Mr. Abu-Reyaleh made periodic surcharge payments<br />
