Glencore did not have the oil delivered to the United States, as agreed in the c<strong>on</strong>tract, but instead<br />

had it shipped to Singapore. Over 1.85 milli<strong>on</strong> barrels were lifted <strong>on</strong> M<strong>on</strong>tega’s c<strong>on</strong>tract at a total<br />

value of $45,502,470, using a United Nati<strong>on</strong>s pricing formula that took into account that the final<br />

destinati<strong>on</strong> would be the United States. As a result of Glencore’s change in shipping destinati<strong>on</strong>,<br />

M<strong>on</strong>tega Trading, as the c<strong>on</strong>tracting company, owed milli<strong>on</strong>s of dollars to SOMO for the price<br />

differential. 204<br />

According to Mr. Hemphill, M<strong>on</strong>tega Trading was not involved in the decisi<strong>on</strong> to ship the oil to<br />

Singapore, and he requested and received a letter from Sopak c<strong>on</strong>firming that the intended<br />

destinati<strong>on</strong> had been the United States. Despite being Glencore’s wholly-owned subsidiary,<br />

Sopak denied involvement in Glencore’s decisi<strong>on</strong> to change the destinati<strong>on</strong> of the oil under the<br />

M<strong>on</strong>tega Trading c<strong>on</strong>tract. Ultimately, Sopak and M<strong>on</strong>tega Trading reached a settlement <strong>on</strong> their<br />

dispute over liability for the increased costs of lifting the oil. While the dispute between the<br />

parties was settled, the outstanding surcharges <strong>on</strong> the M<strong>on</strong>tega Trading oil purchases were not.<br />

According to Ministry of Oil records, a surcharge of approximately $464,632 ($0.25 per barrel)<br />

was imposed <strong>on</strong> the oil that Glencore had lifted. As part of their agency agreement, Sopak agreed<br />

to pay a fee to M<strong>on</strong>tega Trading of $0.30 per barrel, which would have covered the surcharge as<br />
