2. Glencore’s C<strong>on</strong>tract with SOMO in Phase IX<br />

Like Bayoil and Taurus, Glencore benefited from the scarcity of willing buyers for Iraqi crude oil<br />

in Phase IX after surcharges had been imposed by the Government of Iraq. In total, Glencore<br />

purchased over 40 milli<strong>on</strong> barrels during Phase IX. Half of the oil purchased by Glencore had<br />

been allocated in the name of its agent, Mr. Abu-Reyaleh. Glencore succeeded in obtaining a<br />

SOMO c<strong>on</strong>tract under its own name to purchase approximately 12 milli<strong>on</strong> barrels of the oil<br />

allocated to its agent. It purchased approximately another 8.6 milli<strong>on</strong> barrels allocated to Mr.<br />

Abu-Reyaleh under c<strong>on</strong>tracts signed by Petrogaz. 291<br />

The main Glencore trader of Iraqi oil, Mr. Alvarez, acknowledged that he was notified of the<br />

possibility of surcharges in December 2000, immediately before Phase IX began. According to<br />

Mr. Alvarez, Ali Hassan Rajab, a senior SOMO official, advised him in a teleph<strong>on</strong>e c<strong>on</strong>versati<strong>on</strong><br />

that Iraq was “c<strong>on</strong>sidering” a request for additi<strong>on</strong>al payments to be made to SOMO’s own bank<br />

accounts. Mr. Alvarez stated that he made it very clear to SOMO that Glencore would not make<br />

any such payments. But a m<strong>on</strong>th after this c<strong>on</strong>versati<strong>on</strong>, Glencore entered into a SOMO c<strong>on</strong>tract<br />
