Mr. Lakani handled the payment of surcharges <strong>on</strong> Incomed Trading c<strong>on</strong>tracts in Phase XI.<br />

According to Mr. Lakhani, he was Glencore’s “man in Baghdad.” As part of a written agency<br />

agreement, Glencore agreed to pay Mr. Lakhani a m<strong>on</strong>thly fee of $5,000 for acting as a<br />

c<strong>on</strong>sultant for Glencore’s “proprietary activities in Iraq for the acquisiti<strong>on</strong> of Iraqi Crude Oil.”<br />

Mr. Lakhani paid approximately $1 milli<strong>on</strong> in surcharges <strong>on</strong> Incomed Trading’s two c<strong>on</strong>tracts in<br />

Phase XI (M/11/22 and M/11/112). 307<br />
