OIL TRANSACTIONS AND ILLICIT PAYMENTS<br />

(Suisse) S.A. (“Crédit Agricole Indosuez”) for 229,375 barrels—a volume nearly equal to the topoff<br />

cargo. 369<br />

Trafigura did not secure a standard letter of credit to finance the top-off parcel of oil. Instead,<br />

Trafigura financed a standby letter for the top-off purchase in the name of Roundhead Inc.<br />

(“Roundhead”) at Crédit Agricole Indosuez. Roundhead, which was named <strong>on</strong> the SOMO bills<br />

of lading for the top-off cargoes, was an “off the shelf” Bahamian company beneficially owned<br />

and operated by Trafigura. On June 14, 2001, Ibex Service & Equipment Ltd. (“Ibex S&E”), a<br />

British Virgin Islands company that was beneficially owned and operated by Mr. Cayre, received<br />

€5.1 milli<strong>on</strong> from Trafigura into its account at Crédit Agricole Indosuez, thereby cancelling<br />

Roundhead’s standby letter of credit. 370<br />

After receiving these funds, Ibex S&E wired €4.2 milli<strong>on</strong> to the bank account of Windmill Trade<br />

Ltd. (“Windmill”) at Banque Audi in Beirut, Leban<strong>on</strong>. Windmill was another British Virgin<br />

Islands “shelf” company that was beneficially owned and operated by Mr. Cayre. The next day,<br />

Windmill wired a payment of €4.2 milli<strong>on</strong> to a SOMO c<strong>on</strong>trolled bank account at Fransabank in<br />

Beirut for the smuggled oil. 371<br />

Mr. Cayre has acknowledged that Ibex S&E channelled m<strong>on</strong>ey to SOMO, but he denied having<br />

any knowledge of Windmill or the payments made through Windmill’s bank accounts. But, as<br />

discussed above, banking and financial records identify Mr. Cayre as the beneficial owner of both<br />
