Development Review Committee The Development Review Committee, based on the staff report finds that the proposed request is consistent with the surrounding land uses and general character of the area; is consistent with the Polk County Land Development Code and is consistent with the Polk County Comprehensive Plan. Development Review Committee Recommendation: Based upon the findings of fact, the information provided by the applicant, and a recent site visit, the Development Review Committee recommends APPROVAL of CU 12-20. 1. This Conditional Use approval allows for the uses of “Vehicle Sales and Leasing,” “Vehicle Service, Mechanical,” and “Vehicle Repair, Auto Body.” [PLG] 2. The applicant shall install a Type “A” Landscape buffer parallel to the frontage of State Road 60, at the top of the depression the chain link fence sits in. [PLG] 3. No outdoor storage of vehicles is allowed. [PLG] 4. Future expansion of the existing uses permitted with this Conditional Use approval (CU 12-20) may be approved through the Level 2 Review process. [PLG] GENERAL NOTES NOTE: Approval of this project shall not constitute a waiver or variance from any applicable development regulation unless specifically noted in the conditions of approval and consistent with LDC Section 930 D. NOTE: All written commitments made in the application and subsequent submissions of information made during the application review process, which are on file with the Land Development Division, shall be considered to be binding upon the applicant, provided such commitments are not a variance with the Comprehensive Plan, LDC or other development regulations in effect at the time of development. Compatibility with the Surrounding Land Uses: A. Land Uses: The area is within a rural area of Polk County. The surrounding unincorporated area is within the A/RR Future land use district. Most of the surrounding lots are vacant; however, to the west is a parcel that is used for access to State Road 60 by both the auto repair shop and a business farther to the west that sells docks, boathouses and sheds. Although most of the area is currently vacant, future development will probably occur with the completion of the CSX terminal in Winter Haven and the Clear Springs project within the City of Bartow’s incorporated area. B. Infrastructure: The site lies within the Rural Development Area (RDA), where most urban services are not present, or are not planned. Since this request is to recognize an existing business, there is no increased demand for urban services or infrastructure to the site. Transportation demand caused by the existing business is already calculated into the Roadway Network Database. A septic system is utilized for wastewater service and potable water is provided by a private water utility, Pinecrest Utilities. Nearest Elementary, Middle, and High School This request is to recognize an existing business. Consequently, school impacts are not germane to this request. No schools are located within close proximity to the site. Since this request is for recognition of an existing business and no expansion is planned, approving this conditional use should not cause an increase in demand for public safety services. Water and Sewer Capacity and Service Provider: The site is located in the RDA where centralized water and sewer service is typically not available and a connection is not required. The business receives potable water from a private provider, Pinecrest Utilities, LLC. There is no sewer service in the area; therefore, the applicant utilizes a septic tank for wastewater service. No expansions or additions to the existing business are planned with this Conditional Use approval, so no new demand for water or sewer will be generated.
