In accordance with Section 915, Development Agreements of the Land Development
Code and Chapter 163.3220 through 163.3243, Florida Statutes, staff’s opinion is that
this Agreement will strengthen the public planning process, encourage sound capital
improvement planning and financing, assist in assuring there are adequate capital
facilities for the development, encourage private participation in comprehensive planning
and reduce the economic costs of development. The Development Agreement will
enable the developer to proceed with development without concern over potable water,
sanitary sewer, and transportation concurrency.
The Office of Planning and Development, based on the current information, finds that the
proposed request IS consistent with the surrounding land uses and general character of
the area; IS consistent with the Polk County Land Development Code and IS consistent
with the Polk County Comprehensive Plan.
Office of Planning and Development Recommendation: Based upon the information
provided by the applicant and staff research, the Office of Planning and Development
recommends APPROVAL of DA 03-04M.
