Case Study 6: Concession areas allocated to several projects<br />

fell <strong>in</strong>side <strong>the</strong> Donghuasao National Protected Area (NPA) <strong>in</strong><br />

Champasack Prov<strong>in</strong>ce. The rubber plantation area for Pav<strong>in</strong>a<br />

Coffee Company Ltd. (see Map A4, polygon <strong>in</strong> red) located <strong>in</strong><br />

Phanou<strong>and</strong>ong village, Paksong District, was found to extend<br />

<strong>in</strong>to <strong>the</strong> NPA by an area of 318 ha. The rubber plantation area<br />

of Chaleurn SCF Company Ltd., located <strong>in</strong> Houaisoi, Paksong<br />

District, overlapped with <strong>the</strong> NPA by a total area of 121 ha.<br />

F<strong>in</strong>ally, <strong>the</strong> rubber plantation of Dakluck Rubber Company,<br />

Ltd., located <strong>in</strong> Namsai-<strong>the</strong>ung village, Pathoumphone District,<br />

was found ly<strong>in</strong>g with<strong>in</strong> <strong>the</strong> buffer zone of <strong>the</strong> NPA.<br />

These three cases reflect <strong>the</strong> poor quality, or lack <strong>the</strong>reof, of<br />

site surveys <strong>and</strong> an ongo<strong>in</strong>g failure to adequately consult<br />

local villagers before grant<strong>in</strong>g <strong>and</strong> allocat<strong>in</strong>g l<strong>and</strong> to <strong>in</strong>vestors.<br />

Site surveys, if done at all, do not necessarily <strong>in</strong>clude survey<strong>in</strong>g<br />

l<strong>and</strong> on site, but ra<strong>the</strong>r are often based on <strong>in</strong>formation <strong>and</strong><br />

maps provided by secondary sources. Fur<strong>the</strong>rmore, l<strong>and</strong> use<br />

plans (if <strong>the</strong>y exist) are often <strong>in</strong>accurate, mak<strong>in</strong>g on-<strong>the</strong>ground<br />

surveys critical. Such surveys are thus tailored to fit<br />

relevant regulations regardless of <strong>the</strong> site context. On <strong>the</strong><br />

o<strong>the</strong>r h<strong>and</strong>, some cases may also reflect <strong>the</strong> pressure of district<br />

authorities to allocate larger areas for <strong>in</strong>vestment projects, if<br />

already granted on a higher level. As already mentioned,<br />

monitor<strong>in</strong>g of <strong>in</strong>vestment project implementation <strong>and</strong> l<strong>and</strong><br />

clear<strong>in</strong>g activities is weak or often non-existent. The last cases<br />

list<strong>in</strong>g concessions with<strong>in</strong> National Protected Areas underl<strong>in</strong>e<br />

<strong>the</strong> lack of communication between l<strong>in</strong>e agencies <strong>and</strong><br />

of various levels of authorities’ adherence to <strong>the</strong> legal <strong>and</strong><br />

regulatory framework when grant<strong>in</strong>g l<strong>and</strong>.<br />

Investor Obligations <strong>and</strong> Agreements<br />

While a range of weaknesses range across <strong>the</strong> relevant<br />

government bodies, <strong>the</strong>re are also a range of cases of <strong>in</strong>vestors<br />

violat<strong>in</strong>g <strong>the</strong> application process or <strong>the</strong>ir contractual<br />

obligations once granted l<strong>and</strong>. In many cases it seems companies<br />

proactively seek to exploit weaknesses <strong>in</strong> <strong>the</strong> l<strong>and</strong><br />

concession grant<strong>in</strong>g system, while o<strong>the</strong>rs simply lack clear directives<br />

or strong requirements under which to operate, both<br />

regulatory <strong>and</strong> <strong>in</strong> <strong>the</strong>ir communication with local stakeholders.<br />
